AEG-MICHAEL JACKSON trial, DAY 1 and the FIRST IMPRESSIONS

What was meant to be an account of the first day of the trial only turned into a chronicle of its first three days accompanied by  some of my spontaneous notes.

DAY 1

April 29, 2013 

My previous opinion of AEG has now been only enforced – this bulldozer rolls over people’s bodies and then hides all the traces by littering the place with blatant lies. Some of their lies are noticeable even in their attorney’s opening statement.

However my resentment with AEG does not mean that I do not have reservations about the Plaintiff’s manner of presenting their case either.

If we assume that the information is adequately reported by the ARC7 Court News people who tweet it from the court premises, the first impression you get is that the Jacksons’ lawyers spring from their own judgment of Michael which may be not often correct. This most probably reflects the preconceived notions of the family too whose worries about Michael always seemed to me over-exaggerated and often misplaced.

Over here I am not surprised as parents often tend to think that their children misbehave when they are not looking, and by assuming the worst alienate their children from themselves, and this is why the fact that Brian Panish is basing his strategy on some of these assumptions does not seem to the best way to handle the case.

A much better one would be to show AEG’s fraudulent manipulations with the contract and their deceit of Michael about the dates, their sabotage of Michael’s decisions and their own slowness in the production process and all the rest of it which turned Michael’s happy anticipation of the concerts into a deep anxiety which lasted for months.

However I also understand that since the matter was reduced by the judge to medical issues only, Brian Panish’s strategy can now be a forced decision, the only one left to him for lack of other possibilities, which makes me suspect that the powers opposing Jacksons counted exactly on this scenario. What they are doing now looks like a ridicule of Katherine: “So you wanted justice? Then we’ll make you feel sorry that you did. The territory chosen for the battle is all ours, so see what we will do…”.

Evil and malice always act that way – they know your vulnerabilities and force you into silence by threatening to hit where it hurts most. This is why many prefer to stay away from the fight even if they crushed your bones and made a feast on your remains. But if you keep silent then it will mean that they will always have their way.

So accepting the “bad points”  from the start of it, with making no bones about it, may not be that bad a strategy after all. It deprives the other side of the pleasure of declaring it first.

The other conclusion I make from the first day is that Brian Panish’s concept of AEG’s intentions and goals is different from my own assessment of it, however I do not object – Jacksons’ attorneys have access to much more information and may know better, and over here I am willing to listen and do not aspire to knowing the whole truth.

The first day also made it clear that AEG has given up all pretence now and is showing to the world its true face. Now it is not stopping at nothing in order to drown in the mud the genius whom they previously sang the praises of.

Their expressions like “he had a deepest dark secret no one knew of” immediately paint the picture of some catacombs where the villain must have been burying people alive, while in reality Michael Jackson’s problem was just a total inability to sleep,  sometimes for several days running and this necessitated some medicine in order just to survive. Normal people will look at this problem with sympathy and it is only AEG and people like them who will feign horror at a mere mentioning of it.

Why don’t all these people discuss Liz Taylor or Mick Jagger in the same manner though both of them admitted drug escapades? Probably because they were awarded knighthood, praised for their excellence and are looked upon by the public as awesome stars, idols and even legends? And all this while Michael Jackson the insomniac should be called the most despicable names?

In short all of it is about hypocrisy again.

When they try to trap you into their hypocrisy nets don’t hesitate to pull it away and snatch its ugly mask off the faces of these fake moralizers.  They’d better looked at themselves and revised their whole system of values before throwing mud at Michael Jackson. He was the biggest victim of their hypocrisy and now needs a break.

As to the Jacksons’ lawyers I wish they had a chance to take a different line of resistance. However even if they can’t, I am praying that the winner in the case will still be the truth. And the truth may well turn out to be different from anything both parties are discussing here.

Despite all the mess of it by God’s will the truth may reveal the sparkling beauty of Michael Jackson’s nature, his honorable character, his pure intentions akin to a child and the enormous love he had for people despite the extreme hardship and pain inflicted to him by other humans since the first years of his life to his dying day.

At the moment the reports of my favorite LA Times are rather decent and well-balanced. The only inaccuracy I noticed in their latest article is that Michael allegedly agreed to 50 shows (he didn’t).

The headline explains the reason why Michael used Demerol at all, and this information should be known to the general public so that they don’t make the mistake of thinking that it was for recreation purposes. In fact it was the excruciating pain of the burn and the scalp surgery that followed it which introduced Demerol into Michael’s life. For those who don’t yet know it let me say that the plastic surgeon was stretching Michael’s scalp and the pain of it had to be dulled by Demerol as the process of it was taking months. This is how it started:

With fortunes and reputations at stake, attorneys began opening statements Monday in a downtown Los Angeles courtroom where a powerful entertainment giant stands accused of playing a critical role in the death of entertainer Michael Jackson.

The wrongful-death suit filed by Katherine Jackson and her grandchildren — Prince, Paris and Blanket — accuses AEG of negligently hiring and controlling Dr. Conrad Murray, who administered a fatal dose of the anesthetic propofol to Jackson shortly before he was to begin his “This Is It” comeback concerts in London.

Brian Panish, the attorney representing the pop singer’s mother and children, told jurors in opening statements Monday that Jackson had developed a problem with prescription medication and at times became “dependent” on the drugs.

Jackson, the attorney said, also suffered from anxiety that “became more prevalent when he was going through a rigorous schedule.”

The entertainer’s drug problem, Panish said, took off in 1984 when he suffered second and third-degree burns while filming a Pepsi commercial.

The wrongful-death suit contends the entertainment firm threatened to end Jackson’s career if he failed to come through with the concerts and ordered Murray to keep the performer on track.

AEG, which owns Staples Center in addition to other arenas and sports venues, maintains it was Jackson who insisted that Murray come on board as his doctor.

The trial begins after three weeks of jury selection in which potential jurors were vetted to determine whether they were even able to sit on a case that could last up to four months. Six men and six women were impaneled last week, and six alternates were also named.

As in life, Jackson’s eccentric lifestyle is expected to take center stage as attorneys poke though the entertainer’s once-massive fortune, his voluminous medical history and the final days when he was attempting to pull off what was being sold as a series of stunning comeback concerts in London.

While Jackson had only agreed to 50 dates in London, AEG proposed a three-year worldwide tour in which one executive estimated ticket sales could exceed $450 million. Billboard magazine estimated AEG’s profits would hit $115 million for the London shows, with Jackson earning $1 million a night.

According to the contract between them, AEG advanced Jackson close to $30 million, which included a $15-million line of credit, a $5-million advance, $7.5 million to cover production costs to mount the shows and rent for a $100,000-a- month Holmby Hills mansion.

According to the lawsuit, if the singer failed to generate enough money to pay back the loans, AEG could seize his assets, among them a valuable song catalogue that includes songs by the Beatles, Aretha Franklin and the Jackson family.

The lawsuit contends that AEG knew of Jackson’s fragile health but put “its desire for massive profits from the tour over the health and safety of Michael Jackson.”

“Three loving children lost their father, a loving mother and father lost their son, the Jackson siblings lost their brother and the world lost its most celebrated entertainer,” the complaint said.

A central question will be who actually employed Murray: Jackson or AEG?

The Las Vegas doctor, deep in debt himself, was supposed to be paid $150,000 a month. Murray, who worked with Jackson for two months to prepare him for the concerts, signed a contract the night before Jackson’s death but it was never signed by AEG executives nor the singer.

The entertainment firm, along with company executives, argues that it was Jackson who hired Murray and insisted on keeping him as his doctor.

AEG is an influential political player in Los Angeles, stamping its reputation by building L.A. Live and Staples Center and now working with the city to construct a downtown NFL stadium to help attract a pro football team. But the company has been in upheaval for months, with owner Philip Anschutz putting it on the market and then just as suddenly pulling it off.

The list of potential witnesses in the wrongful-death case is guaranteed to bring out the paparazzi and gossip traffickers. Jackson’s mother and father, sibilings and other relatives — close to 20 Jacksons in all — are expected to testify. So are Michael Jackson’s children.

Also on the witness lists are performers Diana Ross and Prince; Quincy Jones, who produced Michael Jackson’s “Thriller” album; filmmaker Spike Lee; Jackson’s former wives, Debbie Rowe and Lisa Marie Presley; AEG owner Anschutz; and one-time Hulk Lou Ferrigno, who was Jackson’s trainer.

While Michael Jackson was having his problems AEG was having his own.  Brian Panish, the Jacksons’ lawyer says that AEG’s problem was that they weren’t not No.1  in the concert business and evidently could not live a happy life until they took the upper hand over their competitor Live Nation.

Let me note in this connection that Live Nation was also brought to Michael Jackson. The person who introduced them to each other was Michael’s lawyer Peter Lopez, however Tohme who was managing Michael’s affairs at the time drove the company away as he was “unimpressed”.

Tohme spoke about it to Randall Sullivan whose book is now quoting Tohme on half of its pages. See how Tohme pretends that it was Lopez who suggested AEG (while in reality AEG was imposed on Michael by Tohme’s friend Tom Barrack who set it as a condition for the Neverland deal) and how Tohme “was unaware” of Randy Phillips courting Michael for almost two years by the time Tohme entered Michael’s life.

Here is an excerpt from Randall Sullivan’s book:

“Lopez first set up a meeting with Live Nation that left Tohme unimpressed. “ I don’t like those guys,” he recalled telling Lopez, who then suggested AEG. Tohme claimed to be unaware of Michael’s previous meeting with Randy Phillips, who had never entirely given up on signing Michael to an AEG Live contract. What really moved things along was a phone conversation between a pair of billionaires, Barrack and Anschutz.”

Immediately after Anschutz got off the phone with Barrack, he called Randy Phillips and asked him to meet with the Colony Capital CEO to talk about what it would take to secure a commitment from Michael Jackson to perform a series of concerts at the O2 in London. Barrack passed Phillips on to Tohme, who suggested that the AEG Live chief meet him for a drink at the Hotel Bel-Air.

“ So we sat, we talked, I liked him,” Tohme recalled. “ He will do anything to have Michael Jackson. He said that. I said, ‘We need advances, we need this, we need that. Let me think about it and talk to Michael.” Phillips’s stock got a boost when Dennis Hawk, the attorney who had been brought in to assist Tohme in managing Michael’s affairs, told Jackson and Tohme that Phillips was “a classy guy” who could be trusted to help put on a show that would be everything they hoped for.”

It is especially after reading about Randy Phillips being “a classy guy” that the article below looks like a refreshing breeze:

Jackson lawyers paint AEG as ruthless, greedy

The attorney for Michael Jackson’s family painted entertainment powerhouse Anschutz Entertainment Group as a gang of ruthless executives concerned only with becoming No. 1 in the concert business and caring nothing about the singer’s well-being.

Attorney Brian Panish began his opening statement Monday in the Jackson-AEG suit by talking about Jackson’s addiction to prescription drugs.

He also mentioned Dr. Conrad Murray, the debt-ridden doctor who administered the fatal dose of propofol to Jackson and was later convicted of involuntary manslaughter.

But it was AEG, Panish said, that completed the puzzle in Jackson’s 2009 death.

“Michael had a problem, Dr. Murray had a problem and AEG had a problem,” Panish told the jury of six men and six women in a downtown Los Angeles courtroom Monday.

“You know what AEG’s problem was? They were not No. 1 in the concert business but they wanted to be.”

The attorney said the company wanted to exploit Jackson to catch up to their competitor in the concert business, Live Nation, at all costs.

“You don’t do that with white gloves,” Panish said. “You do what you gotta do if you want to be No. 1 in this rough business of concert promotions.”

The wrongful-death suit against AEG was filed by the singer’s mother, Katherine — who was in the courtroom Monday along with Michael Jackson’s siblings Rebbie and Randy — and his three children. Jackson died on the eve of what was to be a comeback series of concerts in 2009.

The suit accuses AEG of pushing Jackson beyond his limits and being responsible for hiring and controlling Murray.

“There were no rules,” Panish told the jury, when it came to furthering AEG’s success. “It didn’t matter what it took. … AEG had a problem and they wanted to fix it and they didn’t care who got lost in the wash.”

Using slides and photos, Panish quoted from emails among AEG executives that surfaced last year as evidence of the attitude. In one, AEG Live President and CEO Randy Phillips described screaming at Jackson, whom he called an “emotionally paralyzed mess,” before a news conference.

“Forget about helping Mr. Jackson,” Panish said. “The show must go on.”

Murray’s involvement only created a downward spiral for Jackson because the doctor’s “financial condition made him susceptible to pressure and created a conflict between his patient’ needs and AEG’s needs,” Panish said.

Here’s what happened in court this morning: prior to the jurors coming in, the parties had housekeeping matters to discuss.

Randy Jackson just arrived in the courthouse. He’s inside the courtroom with his mother.

Hallway is filled with reporters again. Everyone is lined up waiting to get in. Our reporter Miriam Hernandez is the number one in the list

Jurors are again at the end of the hallway. No one is allowed to interact with them. We can’t even say hello.

Katherine Jackson in hanging out in the cafeteria at the courthouse. She’s walking around the outside area with bodyguards and sheriff

No one seems to be bothering Katherine Jackson. Everyone giving her the space she needs.

There was last minute change in the order of the witnesses. First one was Richard Senneff, paramedic/firefighter who tried to resuscitate MJ

Senneff explained what a paramedic does and the different machines in a rescue ambulance which are related to trauma and cardiac arrest

Senneff detailed the coverage area of the LA city department, what areas they serve and difference between city and county of LA

Senneff: “You learn so much about the community” He said there are about 1100 paramedics in the city of LA, about 1050 are firefighters too

Katherine and Randy Jackson left the courtroom when Senneff began testifying. They didn’t want to hear/see what happened in the house

Senneff: I came in to that front door and saw what later I found out was Dr. Murray and a patient on the bed

Senneff: He was leaning over the patient, patient laying on the bed, dr Murray standing there and they were moving the patient to the floor

When I first walked in, I asked dr Murray is the patient had a DNR, Senneff recalled.. DNR= Don Not Ressuscitate

Senneff: I saw a patient wearing pajama pants and shirt, and some surgical cover over the head. He looked very pale, very weak.

Senneff: “Patient looked underweight to me.” He also said he “appeared to be chronically ill.”

Senneff said initially he was not able to identify the patient, but as it progressed someone said his name was Michael Jackson

Senneff: “Once someone said his name, I looked at the patient’s face and saw it was Michael Jackson.”

Senneff: “I asked what his underlying condition was…. the doctor said nothing, that he was just treating him for dehydration & exhaustion”

But Senneff said the patient did not look like one suffering from dehydration exhaustion, which are relatively mild conditions.

Senneff asked what kind of medication patient was taking. Sennef said that according to Dr. Murray, “he was not” (taking any medication)

Senneff said when he moved MJ, he felt he did not have a pulse. His pupils were fixed and dilated, eyes were quite dried

Senneff: “When I picked him up and moved him, he was cool to the touch. I would say less than an hour… Body doesn’t get cold that fast”

Senneff said MJ’s chest was pale white, his hands and feet turned blue from not getting enough ventilation/oxygen.

Senneff: Dr Murray had a white plastic bag in one hand. When I came to the door he froze, he was actually surprised to see me (in MJ’s room)

Upon arrival at UCLA, Senneff explained to the ER doctor what he had done, like a quick recap, no changes in patient’s status.

Senneff described a situation with a Russian woman at UCLA who passed out when she heard MJ had died. “I helped her out,” he said.

Senneff said the American Heart Association indicates CPR is performed on a bed it’s less desirable. One must place patient on hard surface

Panish said Dr. Murray performed CPR with Michael Jackson on the bed:  “That’s not how you’re supposed to do it,” Senneff opined.

I said it too soon about the LA Times – now they have also stepped on the slippery road of biased reporting. First a certain “fan” said to them that the case “is not about justice but about who is going to make money” and now they happily report these words in all their latest articles.

Never knew that the dubious opinion of some “fans” was so valuable to the LA Times that they would make so much fuss over it.  This makes me feel proud that I am no “fan” but a Michael Jackson supporter.

Michael Jackson on deathbed looked like cancer patient, witness says

Pale and emaciated, Michael Jackson lay on his bed in his $100,000-a-month Holmby Hills mansion looking like an end-stage cancer patient who had come home to die.

The scene inside the house where Jackson lived as he prepared for a comeback tour was described Tuesday in stark detail by Richard Senneff, the lead-off witness in a wrongful-death case brought by the pop legend’s mother and three children against entertainment firm AEG.

Stacked around Jackson that day in June 2009 were oxygen tanks, an intravenous drip and an emergency breathing aid, the Los Angeles City Fire Department paramedic testified. The singer’s ribs were visible on his thin body, his eyes were dilated and dry, his lips were a faint blue and an IV was attached on the inside of his lower left calf.

“He looked like someone who was at the end stage of a long disease,” Senneff testified.

Senneff said he asked Dr. Conrad Murray, who was standing nearby, if Jackson had a “do not resuscitate” order.

“Dr. Murray looked at me blankly at first,” Senneff said, answering questions from Brian Panish, the Jackson family’s attorney. Then the doctor said, “No, no, this just happened.”

Senneff said he could not find a pulse and concluded that the pop star had been dead for as long as an hour.

“It didn’t make sense that it had just happened,” Senneff testified.

The testimony appeared aimed at convincing jurors that Murray was in over his head in treating Jackson and unfit to take even basic lifesaving steps such as CPR to save his famous client’s life.

The wrongful-death suit, which is playing out in a downtown Los Angeles courtroom, contends that Murray was a hired hand for AEG and under firm orders to make sure Jackson pulled off the upcoming “This Is It” concerts no matter what.

Panish said outside the courtroom that Murray’s desperate need to pull himself out of a financial hole conflicted with his care for his patient. If Jackson did not perform his 50 comeback concerts scheduled at the O2 Arena in London, Panish said, the doctor would not receive the $150,000 a month outlined in his contract with AEG.

AEG’s attorneys have countered that it was Jackson who wanted to perform again to help erase his own massive debt and who insisted on using Murray, who had treated him the previous three years. And the contract, lawyers for the entertainment firm said, was never signed by AEG or Jackson.

Much of Senneff’s testimony echoed what he said during Murray’s 2011 criminal trial, in which the doctor was convicted of involuntary manslaughter for administering the fatal dose of the anesthetic propofol to Jackson. Murray is completing a jail sentence in that case.

On Tuesday, Jackson’s mother, Katherine, and brother Randy left the courtroom before the paramedic testified about the details of the entertainer’s death.

Senneff testified that Murray, who was sweating and appeared frantic on the day in question, said he was treating Jackson for dehydration and exhaustion and that the singer was not taking medication.

After moving Jackson to a gurney downstairs, Senneff returned to the singer’s bedroom to retrieve his medical equipment and bumped into Murray. He said the physician looked like “a deer in the headlights.”

“When I came through the door, he froze and he was obviously surprised to see someone come in,” Senneff said. He said Murray, who had identified himself as Jackson’s cardiologist, had a white plastic bag in his hand and was picking something up, although Senneff couldn’t make it out.

Our author Lynette is breaking down for us the medical side of the story. She explains that Murray’s idea about Michael’s own stash of propofol is a lie as he could not buy it himself (you require documentation for it) and that the reason for Michael’s loss of weight was the instruction from Murray not to eat for 8 hours before anesthesia.

This is the best explanation I’ve ever heard as doctors indeed warn against eating before anesthesia. Well, if AEG did not care about Michael’s loss of weight themselves, they could have at least checked on Murray’s activities, especially since they were to check how well he was fulfilling their instructions anyway:

  • I think there is a serious misunderstanding in the fan community as a whole that Michael had a responsibility to not ask for the Propofol. Well I have to respectfully disagree because Michael was the patient and Murray was the doctor. He had the control of the entire situation because he not only administered it he procured it in order to administer it. Michael could not order it for himself because you need a DEA number to order any drug from a pharmacy.
  • It was and always will be up to the professional not to do something that will harm the patient and Murray knew what he was doing. Murray did not tell the truth to a single person in this situation, what makes you think he told Michael the truth? One thing none of you know is the difference between how a patient views a nurse and how they view a doctor. The nurse can educate you and tell you that something is not a good idea but if the doctor comes along and says it will be okay the patient will always believe the doctor simply because they are the doctor. I doubt if Michael was any different than anyone else in that regard.
  • I will say that I thought it was not possible for Murray to have been doing this every night for 60 nights but it seems that he did. Whether or not there was only the one that I believe was a near miss we will never know for sure. But doing what he was doing as often as he was doing it, it was just a matter of pure luck that Michael did not die 3 weeks or more before he did. The difference that I believe happened that night has to do with Murray’s arrogance. He had been doing it for a while with no bad outcome, just a close call or two, and he just plain got sloppy.
  • Michael was losing weight because he was doing what he was told by Murray I am sure. Before you administer an anesthesia to someone you have to be NPO (nothing by mouth) for at least eight hours prior to the administration of the anesthesia except of course in the matter of an emergency. This is to prevent the possibility of the deadliest of possible side effects of an anesthesia and that is nausea. If you become nauseated and vomit while sedated you will aspirate that vomit into your lungs and die from the aspiration. That is why Michael was losing so much weight. The weight loss was not a side effect of the medication per say, it was a side effect of listening to his doctor’s instructions so the medication could be administered.
  • Paramedic Seneff said that Michael looked like an end stage hospice patient. He did not tell you that the blue lips, feet and hands (mottling) show more than anything else that Murray started that drip and walked away for hours. Michael was also given massive amounts of benzodiazepines (the benzodiazepine effect stated in the coroner’s report). They had started to peak during the time that Murray started the drip and left the room. That slowed Michael’s respirations to the point that he was not oxygenated enough for the oxygen to reach his extremities even while his blood was still circulating. This probably went on as long as an hour if not more before he fell into a deeper state of sedation from the Propofol and went into respiratory arrest. So Murray wasn’t even sitting by the bedside counting his respirations. Michael could not possibly have awakened to give himself anything because his brain, deprived of oxygen, shut down long before the Propofol shut it off.
  • In other words he was in a coma and probably brain dead long before Murray ever reentered that room that morning.

So Michael must have died sometime around 11 o’clock or earlier. Just imagine that what is called “extremeties” now were the feet dancing only 12 hours before that.

When he began investigating Michael Jackson’s death in 2009, Los Angeles Police Det. Orlando Martinez at first concluded that the cause was accidental or natural.

But when the detective discovered the deep financial straits of Jackson’s doctor, Conrad Murray, he shifted his thinking and pondered whether he had discovered a motive for the pop star’s death — “financial gain.”

Martinez was the second witness called Tuesday in a wrongful death lawsuit that Jackson’s mother and three children filed against Anschutz Entertainment Group, accusing the entertainment giant of negligently hiring and supervising Murray.

AEG says it was Jackson who employed Murray, and that the $150,000 a month the company was supposed to pay the doctor was an advance to the singer, much like the money it had loaned him to pay for his Holmby Hills mansion and production costs for the upcoming “This Is It” concert series in London.

On the witness stand, Martinez said that he learned that Murray’s Las Vegas home, on which he owed more than $1.6 million, was worth just a little more than $1 million and was in foreclosure.

The doctor owed hundreds of thousands of dollars in tax liens, child support and other debts, and he had closed his office to work with one patient — Jackson, tying his financial future to him, Martinez said.

Martinez said Murray’s deep financial distress led him to believe “that he may for this easy money, the $150,000, he may break the rules, bend the rules to do whatever he needed to get paid. It might solve his money problems.”

The detective said that when he interviewed Murray with two attorneys present, the doctor made up a story to protect himself.

 “He was not being honest and forthright,” Martinez testified.

Martinez’s testimony was part of the Jackson family’s lawyers’ strategy to show that Murray was more concerned with getting himself out of his financial hole than caring for his patient, and that AEG should have checked him out.

Murray was convicted of involuntary manslaughter in 2011 for giving Jackson a fatal dose of the anesthetic propofol to help him sleep. He is completing a jail sentence.

Since the gravity of Conrad Murray’s financial problems is no surprise to us let me focus on another point.

Who was to pay Conrad Murray after all?

From Marvin Putnam we have already heard that Michael expected AEG to pay for the doctor, and the confirmation that the expenses on Murray were indeed AEG’s obligation is found in Randall Sullivan’s book. His source Tohme, attempting to paint Michael as too self-important,  recklessly blurted out the truth – the expenses on Murray were AEG’s responsibility and it was after a long, long argument that the poor company had to agree to the impossible demands.

Here is an excerpt from the book and please do not allow this “self-importance” bias to distract you from the fact that it was AEG’s responsibility to pay for the doctor:

“Of all the demands that Michael Jackson made during the negotiation of the contract for the O2 shows, his requirement that AEG pay for the services of a “ personal physician” had been the one that Randy Phillips and the company attorneys resisted most vigorously. Jackson’s refusal to compromise on this point suggested that his sense of self-importance had made a comeback every bit as extraordinary as the one Randy Phillips hoped to see onstage at the O2.

“ Look,” Michael told Phillips, “ my body is the mechanism that fuels this entire business. Just like President Obama, I need my own doctor attending to me twentyfour/seven.”

Paul Gongaware remembered Jackson pointing to himself and saying, “This is the machine. You have to take care of the machine.”

Frank Dileo pointed out to Phillips and Gongaware that hiring a personal physician might be a good way to separate Michael from Arnold Klein, whom all three men believed to be Jackson’s primary drug supplier. AEG agreed to pay for a private physician, even yielding to Michael’s demand that he alone be permitted to pick the MD who would live with him.”

So AEG agreed to pay to the doctor, supply him with the equipment necessary for taking care of Jackson and provide an assistant to him, but in return they demanded that he should perform the services requested of him by the Producer and not Michael Jackson? This sounds logical and even fair as the one who pays is ordering the music too.

And the music they did order  – AEG gave Murray various tasks, like making Jackson attend every rehearsal, taking care of the insurance and not paying attention to hysterical guys like Ortega, etc.

But  the equipment they did not provide and the payment they did not make.

Yes, going into a deal with AEG Live is like playing football on a field with one gate only.

But the worst insult of it is that after two months of playing games with Murray and Jackson, AEG added a point to Murray’s contract which shifted all medical expenses onto Michael Jackson’s shoulders.

It wasn’t enough for them to have all production expenses to be paid by Jackson – they decided to add the doctor as well though their previous agreement was a different one.

Poor Michael died evidently never knowing that he was to pay for Murray as well…

I r eturned to this topic ti illustrate how difficult it is to go agaist some such as AEG.Another name (unclerly written down in a hurry in the dark) Larry or Lenny Bower.I have no time now to try to explain their roles in the Wall Street scams or the attempts to get some into justice.     This type of thinking amazes me. It reminds me of those who say to fighters against tyranny – don’t even try, they will crash you anyway, it won’t get you anywhere, you will make it only worse, so stay quiet and live a happy private life asking no questions. The price of the fight is indeed too high – loss of freedom or even life.

    And over here AEG is blackmailing everyone by threatening to sling dirt at Michael and the media is lying in wait in order to join in and everyone is already standing on their knees?

    But if you think so bad of him why are you praying to him at all?

    It seems that there are very few people among the fans who do NOT think bad of Michael, and I am one of them.

    Last night also listened with half an ear at a sports program. The following words caught my attention: It is different if they(the players,football) play 25 0r 15 games in 80 days. Also one re horses, well you do´t run a racing horse every day, it is different with farm horses(do these still exist?) who do some work every day ,but are not pressured to maximal performance.
    Someone who knows about racing horses,tell us how often they run,compete in sprtints.
    Just trying to find somethings for comparison for what was expected(unreasonably so) from Michael

    I don´t mean that giving a loan in itself is fraudulent. But giving it to people you well know will not be able to pay it back, but end up in a kind of economic bondage is fraudulent. There was one man,named, who had investigated this thorougly, I have the name at home and will try to remember to take my notes with me next time I need to write on a borrowed computer
    with a timelimit.–Will the forbidden F-word be allowed in Katherines suit,. I wonder.

    I am still on a librarycomputer. Last time I told you about the mafia and high finance. The man who brought this into the open, first did not get his customary bonus, and was later kicked out. -Last night I saw a most interesting documentary made in US about fraud and crimes of high finance.They have managed to get some small fish, but not one from the real high finance.It was said (but my words) that the US justice system became timid and avoided any suites against the real big perpetrators of fraud and they said
    crime, although the latter will be hard to prove.The documentary was made this year and was called of all things The UNTOUCHABLES: One of the main actors in this fraud on home owners and small investors had painted the following words on his car: Fund–them.The intention of giving fradulent loans that came to an end in people losing their home or investment and left with a loan.I did try to write down some names,but dont have them with me in the library.Well it remains to be seen if AEG and ColonyCapital are untouchable too. They said (again not just my words) that the US Justice system has been blamished. Recall one poster saying that Katherine is abusing it.Once again thank you Helena and others who fight for truth.I hope
    the justice system has not totally been severed from truth and ethics.Should there not be some connection?.

    Kaarin, I have no illusions about those who are in power in this world, but talking about the globality of it is very depressing – when it is so “global” it feels like you cannot do anything about it.

    But I think that we can and each should start with his or her own self – with cleaning our thoughts and deeds first, with stopping to be indifferent and with doing our best for some good cause. Not for our dear selves but for all the rest of us or for someone like Michael who gave his whole self to us and to whom we (the world) are greatly indebted.

    We should repay him now – simply by doing what he asked us to. Look in the mirror. Change the world. Keep the faith.

    The events of the morning hrs 25.6 remain unclear. Security video wiped out. Was there 2 ambulances at different times. The official time of death is far off the real one. I do not believe in those 2 min at all. And Micael was well strapped, iv lines, urine cateters emptying in a bag fastened at his bed. Murray tidied up before any police invstigation, Tells tall stories about Michaels stach of propofol. So maybe Michael was given propofol during the setting if a dental implant. This requires boring into the bone and requires anestesia. Called dental surgery.

    Even asking this dentist to be a witness. Anyting to sully michael, even quite legit thing will do if perhaps the public jumps to conclusions negative to MJ. What about those scrapes Michael had on hid legs, chins?

    The freezing and chills he many times complained about are side effects of propofol,common, and occur after the anestesia. Where did Murray do his texting and phoning? In the same room or did he go to an adjecent room so as not to disturb michael?

    Yes, they are waiting. Waiting for AEG to unleash their ugly stories to then make the most of them. But they are also studying public opinion at the moment to see how far they can go and are “warming up” the public against the Jacksons.

    Lots of people are now spilling out hate towards the family and are talking about everything except the essence of the case. Does everyone who sues companies get the same kind of treatment in the US? Why have Americans suddenly become so negative about what looks like their favorite pastime?

    This mobilizing people for negative comments can be done only by AEG. Yesterday I read the comments and noticed the same people writing the same things for different papers. One person wrote about some fragrances launched by the family as if it was a complete crime. So what (and why not?) and what does it have with the AEG trial?

    We need to leave our comments everywhere we can and – while they talk about “fragrances” – jump at the chance and tell the public the whole truth about the AEG case, even the things that will not be discussed at this trial.

    A day without a comment on the way AEG treated Michael is a day lost and wasted.

    Has anyone ever read the Murray search warrant for his car and what was found there because that does show the MJ was on a nightly drip and it can be set to a gravity drip to run in like Muray did. If yu set it for 30 mls. per hour you would have a rate of 300 mg per hour.
    Here is a link and depending on the level od either sedation, induction or maintenence it will give you the answer of hw many mls. to administer per hour. MIchal was 67 kilos.

    Is there school or special courses given for sleazy lawyers? Of the 3 trials involving Michael the only attorney whom I thought acted well other than Mr. Mesereau was Mr. Chernoff. Mr. Flannagan reminded me much Sneddon physical and spiritually.

    True Mr. Chernoff was trying to prove Michael had accidentally killed himself, but that is the job of a defense attorney. I got the sense it was not he would had intended to retry the 05 trial as a defense tactic.

    There aren’t many Media reports just the same video footage with a refreshed dialogue each day. I have the feeling the Media is waiting on the Defense team. Waiting on them to make good on their threat of “ugly stories” to be unleashed. I suspect the number of news teams will increase when the defense comes up to bat and what is already a too small courtroom is so packed there may not be room.

    Whether by drip or by bolus, I can’t see anyone surviving near misses with over 200MG of propofol “per session”, for 2 months without equipment or monitoring (was there an infusion pump?). That would be a miracle.

    As far as Michael’s deteriorating health goes, according to ‘This Is NOT It’ fan testimonials (fans who followed and met Michael throughout Spring 2009), they were concerned as far back as March 2009. Weeks, months of not being able to sleep at night, and exerting so much physical energy during rehearsals in the afternoon and evening, would have taken an enormous toll not just on his body, but also his psychological state – not to mention, dealing with AEG’s lies and scheming (Also bear in mind that this man was weeks away from his 51th birthday!) So we can’t be sure the “episodes” he suffered from in June, were from the propofol.

    The people who know how Michael was doing are his children, his family who saw him in May , Karen Faye, Bush and Tompkins who were physically close to him and the other people from the production who may know a lot but were / are under confidentiality agreement. Kai Chase said she left in May when he was still vibrant but when she came back after 3 weeks in June he had drastically changed. But in May he was already having propofol so the truth is somewhere in the middle. To me he didn’t look good on the announcement march 5th, not on the family photos in may and not in This is it. When he sings Human nature I get goosebumps but its too painful to watch. Camera optically ads about 10 pounds to peoples physic, so in reality he must have looked thinner. There are dancers who anonymously said that he had collapsed on stage once and they were asked to pray for him. But that was ofcourse contractually silenced. I hope they will speak up in court..

    This is correct. And even propofol as such is not to blame. People have it hospitals on a regular basis and no one dies. If properly administered it is safe.

    Dear escapemj, sometimes it won’t harm to educate yourself a little before you write all these exclamations.

    I doubt that it was even AEG who was “doing the shows” because it was Michael Jackson who was to pay for everything. If the artist is to pay for everything he does not even need a producer.

    And there is no heroism in AEG producing “This is it”. They sold the footage for $60 mln. and got extra $5 mln. for making the film. And then they cut a portion for themselves in the money the film collected. And I am not even sure that AEG had the right to that footage at all – it was supposed to be Michael’s, for his home library as Kenny Ortega used to say.

    Do you have any idea how your hero AEG exploited Michael Jackson?
    I suggest you do some reading before disgracing yourself further with all this misplaced fury.

    Is not it enough to have arrested the doctor (yes this had PORTION of guilt, and not full by the death of Michael!) Now want to go after AEG, a producer who was doing the shows and produced This Is It!

    Curious that the Jackson family had this BRILLIANT idea, that AEG Live could be one reason for the death of his son, after he was released This Is It (the film) grossing over $ 250 million, grossing only after sales CD and DVD!
    Needless to say, the premiere of the film almost all members of the family was there in the front row and taking photos for the premiere of the film made with the help of this production “MURDER!”

    Now, almost four years later, it was released, it does not yield much, solves process!

    It is MUCH COINCIDENCE!!

    Glad that Michael Jackson is dead!

    So he witnesses this whole circus!

    Michael would not have survived one day if he’d received general anesthesia levels of propofol (the levels found in his body when he died) for 2 months, because there was no equipment to do it safely – BOTH Michael and Conrad Murray knew it (based on Murray’s request to AEG for CPR equipment). If he was administering propofol to Michael at all in the previous 60 days, it had to be in controlled doses – maybe a bolus with other sedatives.

    What people keep overlooking is that what happened on June 25, 2009 was not just a deviation of standard medical care, but it was most likely a radical break from Murray’s 2 month routine with Michael.

    The person who gave Michael that lethal dose of propofol had to have know that Michael would suffocate and die. There was NOTHING involuntary about it.

    The question that wasn’t answered by the criminal investigation and Murray’s criminal trial remains: Why was Michael killed?

    BTW, when people talk about Michael dying “from propofol”, keep this in mind: When someone drowns in a pool or river, no one says they “died from water”, but rather they drowned. Well, Michael didn’t die just from propofol, he died from being DROWNED in propofol.

    It’s an important distinction.

    Lynande, I’m reading the LA Times now and there is no mention there of opiates. They are only talking about Michael’s emaciated condition which is true. “Opiates” were mentioned by the ABC7 tweets however we don’t know the context and what exactly was said.

    The other media does not really differentiate between addiction to Demerol and use of propofol to which a person does not get used as you have explained it so well – it does not have the receptors in the brain for it, so the dependency does not develop.

    The impression I get at the moment is (keep my fingers crossed) that the press is more or less okay BUT they are waiting for public reaction. And the public is AWFUL. It indeed seems that all of them have attended one seminar and are saying one and the same thing. Money. The family. They themselves did nothing and now want AEG to answer. AEG had nothing to do with it (!). It was MJ who hired Murray, and not AEG (!!!), etc.

    The public reminds me of a crowd of trolls who gather in thousands whenever someone says a word of truth in my country. Name calling, profanity, twisting every statement, mockery at your naivety, etc. I really get exactly the same impression of seeing either complete idiots or someone who is paid for the lies and dirt. The same gang of people both here and there.

    Look here, if we keep silent and don’t leave our comment there this slant can be cemented and be seen as an invitation to harass the Jacksons. If the public asks for it the press may follow suit – it’s the public demand, you know.

    I’m going into the field.

    So AEG is also responsible for his “illness” because Michael agreed to this under the duress that they caused. They suspected Arnold KLein for this and if they had investigated Murray even a lttle bit they would have known who the real culprit was.

    @lyande51, I agree with both your comments; BOTH sides are willing to paint Michael with a broad addict brush for decades of his life rather than the sporadic periods during which he did use prescription medication for pain relief. And, yes, the emaciated and ill look became apparent only after Murray commenced the heavy duty use of propofol. Even JJ in his book said Michael looked fine at Chakra’s on May 14th, and then by June 25, appeared to have wasted away.

This is probably the most misleading thing about this drug use that they are talking about. Just because you were actively addicted to opiates at one time or another does not mean that you will or even can become addicted to propofol.

    Dial, you are absolutely right in speaking about the slant. CNN has always been a special “friend” to Michael, but I’m noticing a subtle change in the attitude of the LA Times too. They made a good start but are quickly catching up with the rest. However the methods used are very subtle.

    1) First of all some “fan” was helpful with this information:

    “I’m happy I can go in, but not looking forward about what’s going to be said,” she said. “This is a trial where Michael Jackson will be thrown under the bus by both parties. It’s not really about justice. It’s about who’s going to make money.”

    2) The paper itself cannot pass judgment, but once the “fan” mentioned it the paper begins overusing it in each of its articles (the latest two or three if I am not mistaken). Since when has some fan’s opinion has become so important that they quote it so often?

    3) The place within the article where this information is posted is also very important. If it is in the middle it is perceived as nothing much and can be easily forgotten, but it is the END of the story that matters.

    The article may quote both sides but if it ends with the “fan’s” opinion that it is “all about money”, this will be the opinion the reader will go away with after he reads the story. The ending makes a lasting impression and sums up the article.

    4) So if you have a look at all the endings of the latest LA Times articles you’ll see that they are not quoting the Jacksons’ lawyers, but only Marvin Putham of AEG or the so-called “fans”.

    If you are curious about it you can count the endings in favor of both parties and see in whose favor the score will be.

    The reason why they are doing it is because the last sentence is a key to the whole article. Even if there is a lot of discussion for and against in the middle, the ending sort of “settles the matter”.

    Examples of endings from the last three articles on LA Times:

    Public vies for seats in Michael Jackson-AEG wrongful death trial
    ….AEG, however, said that although it was common knowledge that Jackson had abused prescription painkillers, company officials were unaware he used propofol.

    Michael did not sign any of those papers and he knew that the case was frivolous, so his only worry could be about Frank Dileo (if he cared for him which he did). This case is not about Michael at all.

    All the fuss made in the press about AllGoodEntertainment was because it was a worrisome factor for AEG, and not for Michael. They were extremely “jealous” and were afraid that Michael would be lured into that deal.

    And in no way can Michael’s concerns about AllGood be comparable to his stress of doing those 50 concerts for AEG.

    What will worry you more – having to run 50 marathons very soon or the fact that your manager messed up over some sprint with your brothers (which you never even signed to)? It will give you just a headache at the most. This is surely not something to occupy your mind on the eve of the first marathon.

    The article is from 13/03/09 , after 50 shows were announced… Its interesting in reference with an AEG email that was revealed in court by Panish and a part in Sullivans book about this subject.This is the email that was revealed in court – Internal AEG email “MICHAEL REALLY WANTS TO DO MOVIES. JUST KEEP TALKING ABOUT MOVIES WITH MICHAEL , DON’T EVEN TALK TO HIM ABOUT THE TOUR.”

    Oh, I missed that email but know the article. This email is the best disproval of their own statements – it was AEG that was eager to get an agreement with Michael, while now they present it as if Michael was seeking them out. I have numerous articles speaking to the same, only there is no space to post all of them.

    As regards the article rereading it now is a rate treat. AEG people themselves made our job easy. Each article is a thrill and is worth a dissertation. Let me also quote the same article and make a little comment (using the mail you’ve just sent):

    And now their laywer Marvin Putnam says that it was Michael Jackson who approached them twice.

    ….The key was a call made to Anschutz by an old friend Tom Barrack Jr, a real estate billionaire who paid $23.5 million for Jackson’s Neverland ranch.

    …Barrack told Anschutz that he and Tohme had agreed to take control of Jackson’s finances. They were rescheduling his $100 million debt and the pop star was ready to meet AEG.

    From other sources now we know that Barrack was the key player as he set Michael’s contract with AEG as a condition for the Neverland deal.

    ….Randy Phillips said: “I got a call from Dr Tohme who gave it to me straight. He said Michael was in really bad financial straits. They were focusing on his assets and big equity but he had a major cash flow problem.”

    It was true – they were indeed “focusing on his assets”.

    …He met Barrack and Tohme in Los Angeles. “They were restructuring loans and settling all the law suits. Michael had got into so much trouble because he didn’t have the security blanket of managers. As sophisticated as he is, he is very trusting, almost to a fault

    So Tohme and Barrack offered themselves as the security blanket of managers, and for a time being Michael must have been happy that he finally found “honest” people to manage his business. Tohme was making huge cuts for himself out of Michael’s earnings and Barrack obtained ownership of Neverland as this was another condition on which he was “saving” it, and these is called a “security blanket”?

    Phillips said: “Michael was put through a whole battery of tests; stress, treadmill, electrocardiogram, bloodwork and he passed them all. It’s a very complicated policy. Its very important he doesn’t perform consecutive nights.

    So the medical check-up wasn’t a mere inspection of Michael’s vocal cords by a throat special as some say now, but the full battery of tests made for the first 10 concerts. And Randy Phillips knew how important it was for Michael not to perform consecutive nights! So Michael did ask them to have bigger intervals between the dates, but despite that they set 38 shows with a one day interval only!

    ….”I have to say when I saw him last year he looked a little frail but this time at the MGM Grand, he looked great. He’s filled out a little. He’s training.

    So in March Michael Jackson was already training. It is AEG which hired Ortega and the dancers only in May. And since they themselves were slow they turned it into a mad race exhausting Michael even at the rehearsal stage.

    Phillips now speaks to Jackson directly each day. “He calls me all the time. We spoke on Wednesday afternoon. He said: [putting on high voice] ‘Randy, Randy no more shows, no more shows.'”

    So after they set 50 shows Michael was so fearful that they would go on with their evil practices that he called Phillips EVERY DAY. He never wanted 50. Even Tohme in Sallivan’s book admits that Michael agreed to 10 dates only but they “locked him up”:

    Michael still believed he would be performing only ten shows when he flew to London shortly after the first of March for the news conference at which the O2 concerts were to be formally announced.”

    Michael’s mood would change dramatically when he discovered that Tohme and Phillips had already made a preliminary agreement that the number of O2 concerts might be increased if public demand warranted it.”

    “Phillips and Tohme prepared plans to at least double the number of O2 concerts. When Michael discovered what they were up to, he burst into a tearful rage, insisting that ten shows was all that he had agreed to perform.

    P.S. In fact in his desire to show how important he was for Michael Tohme gives out so much valuable information that it deserves a separate post.

    “My subconscience brought up the recollections of Dr Rogers at the Murray trial stating the Michael was healthier than most people his age. Contrast the recollections of Karen Faye stating that MJ had lost a tremendous amount of weight; and Michael Bush said MJ’s condition was blatant and when was someone going to listen? (ABC’s MJ special). Why was the coroner’s report so contrary re: his weight?” – Jolie

    The coroner’s report is the only one legitimate here. But what the others were saying was also true. They were witnessing him losing weight – so they were observing the process and realized that if it went that way further it would end in a catastrophe.

    So the coroner registered the fact that at the time of Michael’s death his weight was still normal (at the lower end of the norm, but still okay) and his friends were speaking of the tendency. This the coroner could not register. And the tendency was that Michael was losing weight and losing it so quickly that very soon it would have been below the norm. Everyone noticed it except AEG.

    Tohme who was fired in March but did not go away at least until May, and did not see Michael for 6 weeks since then (until June 23d) left the following account in Randall Sullivan’s book:

    March 2009: The night before the March 5 announcement at the O2, Tohme commented on how fit Michael was looking, saying it was obvious he had added some bulk. Michael stripped to his underwear and stood on a bathroom scale that showed him weighing 157 pounds. “We were laughing,” Tohme remembered, “ because of stories in the newspaper about how skinny he is, that they just keep printing the old news, they don’t even care what is true now. You should have seen Michael’s legs. They were like an Olympic sprinter’s, like steel bands from all the dancing. The guy is solid muscle.”

    June 2009: Tohme hadn’t seen his client face-to-face in five weeks. And was horrified, Tohme said, when Michael ran forward to wrap him in an embrace: “ I felt his bones. I was shocked to see the weight he had lost. I asked him, ‘Michael, what’s happening with you?’” Michael just laughed off the question about his weight, and went back to rehearsals. Only minutes later, though, he pulled Tohme aside to complain tearfully that, “ They’re torturing me.”

    He asked what was wrong, Tohme recalled, “ and all Michael told me is that they’re asking him to put things in his ears. He hates things in his ears—the microphone, you know, he doesn’t like that.” It felt like someone sticking a fist in his ear, Michael said, but they wouldn’t let him take it out. “ I said, ‘Michael, just don’t wear it if you don’t want to. You are the star.’ But he said, ‘They’re making me.’” Within moments, though, Michael was back onstage performing, and looked as if there was nothing at all bothering him. “ It was confusing,” Tohme recalled.

    Please don’t pay attention to Tohme’s assurances of how much he cared for Michael. It is not the whole truth either but is another story to tell.

    “Then what Seneff was referring to was something called motteling (the ‘blue” handsand feet). This is caused from hypoxia ( not enough oxygen) in the blood while it was still circulating. It is seen when a persons respirations stops or slows before they die. To me it means that Michael didn’t just stop breathing suddenly but his breathing slowed for quite some time before it arrested.Then that also proves that Murray was not paying any attention to Michael for much longer than he says.”

    The picture you are painting is very sad. No wonder Michael’s mother could not hear it and left the room.

    And the process you’ve described absolutely fits in with Dr. Shafer’s conclusions. He said when Michael’s brain died due to propofol it stopped sending signals to the lungs to breathe, so breathing stopped too. But there was still some oxygen in the lungs and the heart went on beating using it, so the blood went on circulating. But with every beat there was less and less oxygen in the lungs and 10 minutes later the heart stopped too as no more oxygen was left. All these 10 minutes the blood was circulating but Michael’s body was craving for oxygen and this is why his feet turned blue.

    Just imagine that only 12 hours before that those feet were dancing.

    Helena thank you so much for for your hard work to keep us informed. (do you ever take a break?) The summary is great , compact and very readable.
    The more we hear, the more I’m connecting the dots about peoples role in Michaels life and its quite depressing. Some things cannot be said now the trial is on. They might be revealed but maybe not ,because the powers are very very strong.

    Here is more proof of AEG s deceptive conduct. Its about what Michael really wanted and how they tricked him into 50 shows.
    I personally never believed Michael wanted to go back to performing on stage.
    He said he hated touring. Now I understand its not so much the touring ,but dealing with the expectations, the stress, his perfectionism and the industry that made it a hell for him. He loved the adrenaline , but he knew it was a killer. He may have agreed to 10 shows to test the waters, and maybe for his children, but that was not where his heart was. Even after BAD he wanted to stop touring and do film.

    These are pieces from an article about Michaels first meeting with Anschuz, Leweike, and Phillips, with Tohme as his representative, as per Randy Philips. Its interesting in reference with an AEG email that was revealed in court by Panish and a part in Sullivans book about this subject . Remember it was Tohme and Barrack ,friend of Anschuz, who boosted the meeting with AEG after they had stopped Neverlands forcluse and Tohme was given POA .

    The article is from 13/03/09 , after 50 shows were announced. This was 4 months after Michael had complained to June Gaitlin about Tohme. Quotes are from Randy Phillips.

    He met Barrack and Tohme in Los Angeles. “They were restructuring loans and settling all the law suits. Michael had got into so much trouble because he didn’t have the security blanket of managers. AS SOPHISTICATED AS HE IS , HE IS VERY TRUSTING , ALMOST TO A FAULT.”

    “MICHAEL TALKED ABOUT HIS AMBITION TO WRITE, PRODUCE, DIRECT AND STAR IN FILM, AND PHIL WHO OWNS THE LARGEST CINEMA CHAIN SAID HE WOULD BE ABLE TO HELP.”

    This is the email that was revealed in court – Internal AEG email
    “MICHAEL REALLY WANTS TO DO MOVIES. JUST KEEP TALKING ABOUT
    MOVIES WITH MICHAEL , DON’T EVEN TALK TO HIM ABOUT THE TOUR.”

    Barrack told Anschutz that he and Tohme had agreed to TAKE CONTROL of Jackson’s finances. They were rescheduling his $100 million debt and the pop star WAS READY TO MEET AEG. London would be the first venue because the executives were not convinced America was ready to welcome Jackson back. Phillips couldn’t believe what he was hearing.

    “Phase one” Phillips told Barrack and Tohme ( NOT MICHAEL??), would be the announcement of 10 shows at the O2 in London

    Phillips now speaks to Jackson directly each day. “He calls me all the time. We spoke on Wednesday afternoon. He said: [putting on high voice] ‘Randy, Randy no more shows, no more shows.

    There are now 50 shows, stretching into January and February next year. While industry insiders remain skeptical -many are convinced Jackson will mime at least part of those gigs amid rumors he was already lip-synching on his last tour – Phillips is confident.

    “MY GUTS tell me he’s gonna do it,” he said.

    But none of us will know for sure until 8 July when Jackson takes to the stage for his first night at the O2. Assuming, of course, that he actually turns up.

    2 Hallway is filled with reporters again. Everyone is lined up waiting to get in. Our reporter Miriam Hernandez is the number one in the list

    3 Jurors are again at the end of the hallway. No one is allowed to interact with them. We can’t even say hello.

    4 Katherine Jackson in hanging out in the cafeteria at the courthouse. She’s walking around the outside area with bodyguards and sheriff

    5 No one seems to be bothering Katherine Jackson. Everyone giving her the space she needs.

    6 There was last minute change in the order of the witnesses. First one was Richard Senneff, paramedic/firefighter who tried to resuscitate MJ

    7 Senneff explained what a paramedic does and the different machines in a rescue ambulance which are related to trauma and cardiac arrest

    8 Senneff detailed the coverage area of the LA city department, what areas they serve and difference between city and county of LA

    9 Senneff: “You learn so much about the community” He said there are about 1100 paramedics in the city of LA, about 1050 are firefighters too

    10 Katherine and Randy Jackson left the courtroom when Senneff began testifying. They didn’t want to hear/see what happened in the house

    11 Senneff: I responded to a patient not breathing

    12 Q: June 25, 2009, do you remember responding to a location with a potential fatality?

    13 Senneff said he arrived at Jackson’s house at 12:25 pm PT and got out of the ambulance with their equipment, EKG monitor, needles, meds

    14 Senneff: I came in to that front door and saw what later I found out was Dr. Murray and a patient on the bed

    15 Senneff: He was leaning over the patient, patient laying on the bed, dr Murray standing there and they were moving the patient to the floor

    16 When I first walked in, I asked dr Murray is the patient had a DNR, Senneff recalled.. DNR= Don Not Ressuscitate

    17 Senneff: I saw a patient wearing pajama pants and shirt, and some surgical cover over the head. He looked very pale, very weak.

    19 Senneff: “To me he looked at the end stage”

    20 Panish: How was the patient?

    21 Senneff: “Patient looked underweight to me.” He also said he “appeared to be chronically ill.”

    22 Senneff said he saw an IV pole and an IV bag on the pole, along with an oxygen tank. There were medicine bottles on the nightstand.

    24 Senneff said initially he was not able to identify the patient, but as it progressed someone said his name was Michael Jackson

    25 Senneff: “Once someone said his name, I looked at the patient’s face and saw it was Michael Jackson.”

    27 Senneff: “I asked what his underlying condition was…. the doctor said nothing, that he was just treating him for dehydration & exhaustion”

    28 But Senneff said the patient did not look like one suffering from dehydration exhaustion, which are relatively mild conditions.

    29 Senneff asked what kind of medication patient was taking. Sennef said that according to Dr. Murray, “he was not” (taking any medication)

    30 Senneff said when he moved MJ, he felt he did not have a pulse. His pupils were fixed and dilated, eyes were quite dried

    31 Senneff: “When I picked him up and moved him, he was cool to the touch. I would say less than an hour… Body doesn’t get cold that fast”

    32 Senneff said MJ’s chest was pale white, his hands and feet turned blue from not getting enough ventilation/oxygen.

    44 Senneff: “Dr Murray reached in our box, he gave additional injection of epinephrine”

    45 Senneff: Dr Murray said he felt femoral artery pulse. However, Senneff said no one else, other than Dr. Murray, was able to find a pulse

    46 Senneff: MJ’s condition hadn’t changed on the way to the hospital. “The hospital asked me about calling (time of death). Dr Murray said no.”

    47 Senneff: Dr Murray had a white plastic bag in one hand. When I came to the door he froze, he was actually surprised to see me (in MJ’s room)

    55 Defense atty Kathryn Cahan did Senneff’s cross examination:

    Senneff: I’m not even going there. I was worried about the patient and all the info I can get

    57 Senneff said it is not unusual for family members, people around the patient not know whether they are taking drugs

    58 Senneff said he let Dr. Murray go through his medical bag since what he was doing was reasonable.

    59 Cahan went through the emergency medical service report again. It asks the weight of the patient, Senneff estimated 150lbs, 5’09-ish

    60 Senneff answers 120 calls per month average. He said he got very good at estimating people’s weight.

    61 He said nothing, nothing, I’m just treating him 4 dehydration, exhaustion.

    62 When Senneff asked Dr. Murray about MJ’s underlying condition:

    63 As to Propofol, Senneff said all he knew it was an anesthetic used in surgeries. He learned through the media that was MJ’s cause of death

    64 Then it was back to Panish for re-direct. Senneff told the court he did not see Dr. Murray actually performing CPR.

    65 Senneff said the American Heart Association indicates CPR is performed on a bed it’s less desirable. One must place patient on hard surface

    66 Panish said Dr. Murray performed CPR with Michael Jackson on the bed: “That’s not how you’re supposed to do it,” Senneff opined.

    68 Panish: Did you think Dr. Murray was fit to perform CPR?
    Senneff: I did not believe he was

    69 As to Dr. Murray, Senneff said: “I did not believe he was telling me the full story at the time.”

    70 Panish: What did Michael Jackson tell you?
    Senneff: Nothing, sir
    Panish: Because he was dead when you arrived?
    Senneff: Yes, sir

    71 Senneff agreed that it is expected that a competent, fit physician be able to revive a patient in respiratory arrest. No re-cross by defense

    72 Second witness was LAPD Detective Orlando Martinez. He took the stand and explained his background and training he has had.

    73 Martinez learned from his lieutenant that Michael Jackson was the victim. He went to UCLA to begin his investigation.

    74 Panish: Did you see anyone at the hospital affiliated with AEG?
    Martinez: I saw Mr. DiLeo and Randy Phillips

    78 Panish showed Martinez photos Martinez took at the house. Martinez didn’t search Dr. Murray’s vehicle because he wanted a search warrant

    79 Martinez didn’t leave Dr. Murray’s car at the residence, wanted a reason for the doc to go talk to him. Car was impounded to a police yard

    80 Seeing pix of MJ’s room, Martinez said he saw IV bag, pill bottles, vials, ambu bag. “It looked like the room had been cleaned up,” he said.

    81 Martinez: “Things had been removed from the room prior to police’s arrival.” He took several pictures to document the scene

    82 Martinez said at that time the investigation was leading to natural or accidental death, no real signs of foul play, but it was odd.

    83 Martinez says he learned from Dr. Murray that there were 3 bags total of medicine in the closet. He went back to the house to retrieve them.

    84 Panish showed pictures of the cabinet w/ the bags inside. Martinez described what was inside the bags: several vials of Propofol, drugs

    Helena, I so appreciate the great work you do on behalf of Michael. And you really serve the fan community and the public in trying to make sense of Michael’s injustice.

    I too am always endeavoring to make the proper sense of Michael’s story. One of the things that struck me today was medic Senneff’s testimony that Michael looked like a patient who had a terminal illness (something to that effect, according to tweets). My subconscience brought up the recollections of Dr Rogers at the Murray trial stating the Michael was healthier than most people his age. Contrast the recollections of Karen Faye stating that MJ had lost a tremendous amount of weight; and Michael Bush said MJ’s condition was blatant and when was someone going to listen? (ABC’s MJ special). Why was the coroner’s report so contrary re: his weight? Karen said when she made up MJ’s body, someone at morgue (or coroner’s ?) said that Michael weighed about 120 lbs. Karen also said Lisa Marie said that MJ weighed no more than 125 lbs when MJ was with her, and he was healthy. Senneff said Michael’s ribs were showing. Coroner reported Michael weighed 136 lbs, which is the low end of normal. To me, this makes no sense. But just one example of the many extraordinary contradictions in the story of Michael, even amongst so-called professionals.

    This might sound minor, but it kind of alarmed me again…There are so many witnesses…why would the coroner’s report be contrary?

    I have been asking God to vindicate His son Michael, and to let the truth come out, whatever it is. I prayed alot today, continuing to ask God…I want to continue to beseech God throughout this trial. This means so much to me. Michael and his children mean so much to me. I pray for Michael’s family. I know that Michael would want me to do that.

    Thank you for taking this on. Already it is confusing. Who did or did not say what. I believe AEG PR people have been preparing for this for a while now and got help from some surprising quarters.

    I am paying attention to the subtle spin campaign from the TV and Online major News agencies.

    CNN, the network which some hoped would be granted rights to televise this trial has been of particular interest. Once I noticed the change in the reporting was done, the rotation of persons doing it and their more on location reporting which started with the Boston Bombing. HLN has an eerily familiar feel. It reminds me of video tapes of Court TV and Hard Copy.

    A constant use of Michael’s name placed in the defendant position of any trial he’s involved in whether alive or not.

    But this is a real doozy.

    I am paying attention to what is done not what is said.

I wonder though what is your take on the proposed Allgood Tour, negotiated apparently by DiLeo, of which Michael claimed to have had no knowledge of signing a contract, wherein he was to perform with his brothers and Janet. According to what I read long ago, while he was preparing for the AEG concerts, Allgood was threatening to sue him for breach of contract, because he wasn’t supposed to perform anywhere until the Allgood Tour in 2010. If this Allgood stuff is true, wouldn’t it seem Michael was pressured from even the Family side?

    I am so grateful to you for taking the time and trouble to post, Helena. Whatever happens during this latest sideshow among the carnival barkers and snake oil salesman, one thing is certain. Greatness and Goodness cannot be smothered, drowned, marginalized, cheapened, dismissed or killed. History shows us this. Michael Jackson’s triumphs, contributions, human failings and missteps, inspiration to many, generosity of spirit and all that make him ONE with his Maker are — since his death — being explored anew and put in perspective by serious writers and scholars, in seminars and symposia and in the many first-hand remembrances revealed by those who knew and worked with him. Michael Jackson’s music and performances are seen correctly as the portal to the man’s heart, soul and beliefs. This activity is at work and growing in many quarters, and represents Michael Jackson’s legacy in formation. His children will live to see it bloom in all of its beauty and truth. Nothing can stop it. Thanks again, for all of your hard work and sharing.
