AEG-Jacksons trial DAY 24. Randy Phillips SLAPPED Michael Jackson

Randy Phillips, top man and President of AEG Live SLAPPED Michael Jackson and almost no one in the media wrote about it.

I just slapped himThis AEG boss slapped Michael and is now explaining it by the need to go a press-conference. His earlier version was that Michael was “drunk”, however when questioned under oath he says that it was an “exaggeration”.

Michael was sober and that press-conference was not even needed as with half a million people already in the queue it did not really matter – they could release a public statement instead.

Randy Phillips slapped Michael because he wanted that press-conference and was forcing him to go there. From the very start of it he was showing his ‘partner’ who was the boss there and who was to obey.

This is how their cooperation started, and this is how it ended too – by them grinding him down to his death. And all Michael saw from his ‘partners’ from the start to finish of this ‘cooperation’ was humiliation, bullying, insults and contempt.

The physical insult of the slap was followed by a further insult of adding 40 more shows to which Michael never agreed. No person in his right mind will now believe that Michael was even asked for a permission to increase the number of shows – who asks for a permission of a person whom you’ve just slapped? Even if AEG asked it was a mere formality which did not matter. 

I think I even know why Michael didn’t want to show himself to the public at that early a stage. Besides the big worry that people wouldn’t welcome his comeback he wasn’t confident of his looks.  Dr. Klein said he was doing some cosmetic procedures which were far from finished at that time, so too much make-up had to be applied to Michael’s face and this is why he looked slightly different from the way we saw him in This Is It.

So he even had a solid reason to refuse. And vulnerable as he was after so many years of seclusion he was afraid to show himself to the public fearful of the reception he would get.  But none of it mattered to Randy Phillips. This methodical guy cared only for his own plans and this is why he slapped Michael and then made him attend every rehearsal though both were a terrible violation of Michael’s rights.

When he is fired from AEG Phillips should look for a job in a prison in some God-forsaken place – his manners are just the right ones for an overseer over the local inmates in case the human rights activists are not watching there.

After more or less getting over the shock of the slap I naturally went to see what the media was saying about this outrage. But over here another shock was awaiting me – a day after the incident became known the media was still not writing about it. They were not even mentioning it let alone giving an assessment of it.

did you slap him -no, yes 2Everything was there – AEG’s old lies about Michael being ‘drunk and despondent, AEG exec saying that it is ‘extortion’, “Murray working for Michael and not AEG”, etc.  –  everything except the shock of the slap Phillips gave to Michael Jackson. There was simply nothing about it, as if it never happened and was never discussed at the trial.

Now I am beginning to understand the inner logic of this theatre of the absurd. The current headlines about the alleged ‘drunk’ state of Michael Jackson are setting the right scenery for the spectators and when the curtain falls and the slap is finally mentioned, everyone will think that Michael was in such a state that he deserved it.

But all this loud story of MJ being “drunk and despondent” is a BIG LIE and this was already proven at the trial.

Phillips shifts all the blame for the lie onto Tohme who was allegedly the one who initially said it, Tohme says (in Sullivan’s book) that it was Randy Phillips’ exaggeration and Gongaware who was also present at the press-conference says that Michael Jackson was sober and was not even smelling of alcohol.

Actually we don’t even need the testimonies of these people as we saw the press-conference ourselves and did not notice any signs of intoxication.

When confronted with his own deposition Randy Phillips explains that Michael was NOT drunk and was NOT despondent:

Q. Was Mr. Jackson drunk? 

A. No. Not to the best of my knowledge, no.

Q. Ok. Was he despondent? 

A. No. 

Q. Now, sir, you testified there that Mr. Jackson was not drunk and he was not despondent, correct?

A. There? Yes.

Tohme and his lawyer Dennis Hawk call Phillips’ words an ‘exaggeration’:

“MJ is locked up in his room drunk and despondent,” Phillips wrote in an e-mail to his boss Tim Leiweke.

“ Are you kidding me?” was the reply Leiweke sent back minutes later. Just the day before, AEG’s corporate chief had attended a music-industry symposium where he answered a question about Michael Jackson’s readiness for a concert series by saying, “ The man is very sane, the man is very focused, the man is very healthy.” “ I [am] trying to sober him up,” a frantic Phillips wrote to Leiweke, as the appointed time of the O2 press conference approached. “ I screamed at him so loud the walls are shaking. He is an emotionally paralyzed mess riddled with self loathing and doubt now that it is show time.”

He and Tohme actually had to dress Michael to get him prepared for the press conference, Phillips wrote to Leiweke: “ He is scared to death.”

More than three years later, Tohme would say that Phillips’s e-mails “exaggerated” Michael’s condition. Dennis Hawk agreed. “He might have drunk a couple of glasses of wine to relax,” Hawk said. “I wouldn’t have blamed him if he drank a whole bottle, given how big the moment was for him.” [R.Sullivan]

And Paul Gongaware who was an eye-witness to the press-conference said that Michael gave him a hug and did not even smell of alcohol:

Did Randy ever tell you that Michael was drunk and despondent before that press conference?
A   No, not drunk and despondent.
Q  Did he say something else?
A  He just said he was having a hard time getting — getting him going.
Q  And did he explain that further?
A  No.
Q  Did you have an understanding of what he meant?
A  I — no. I was just too busy at the press conference.

Q. Describe a little bit the scene. Was there any press?

A. Not in the area backstage. He walked into that area and he saw me and he came up to me and he gave me a big hug. And he whispered in my ear, he said, “make sure the teleprompter has big words. I don’t have my glasses.”

Q. OK. Were there Teleprompters to assist him?

A. Yes.

Q. All right. And what big words for what? What did he need words for?

A. On the Teleprompters.

Q. OK. How did he seem to you?

A. He was good.

Q. Did you say anything back?

A. I said OK.

Q. OK. Who did he arrive with?

A. He came with Dr. Tohme, Randy, some security. I don’t remember who else was with him.

Q. So after he gave you that hug and told you he’d forgot his glasses, what happened next?

A. Then I said, “are you ready?” he went, “yeah, let’s go.” and then we had like an emcee, I guess you’d call it, that went up and sort of announced  you know, made the announcement, “here’s Michael Jackson.”

Q. Now, when he came in and hugged you and spoke to you, did he seem inebriated in any way to you?

A. No.

Q. Did he seem drunk?

A. No.

Q. Did he smell of alcohol?

A. No.

Q. Did he seem altered in any way?

A. No.

So Michael was absolutely not in a condition in which Phillips initially described him and therefore he did not have even a pretext for slapping Michael Jackson to bring a ‘drunken’ person to his senses.

Michael was SOBER and let us remember it once and for all.

But Phillips nevertheless did hit him. We learned about this abominable deed from the trial transcript posted on TMJ and if it were not for the transcript we wouldn’t even know of the slap incident as even the ABC 7 Court News somehow managed to omit this crucial fact.

The transcript says that the truth was revealed by an email Randy Phillips wrote to the transportation people waiting downstairs to take them to the press-conference. He said, “I just slapped him” and when pressed for an answer at the trial engaged himself and the Jacksons’ attorney in a long and enduring dispute.

Panish asked him about him hitting Michael as if in passing:

Q. Then by the way, did you hit Mr. Jackson ?

A. No.

Q. Ok. Well, let’s see what you said at the top of that page at 712/17. Why don’t you read what you said, sir?

A. This is in response to getting the transportation set up. I said:  “you guys are going to follow us behind a 12-passenger bus back there. I just slapped him and screamed at him louder than I did with Arthur Cassell.”

Q. Who is Arthur Cassell?

A. Arthur Cassell is one of the most annoying human beings on the face of the earth [….]

Q. But this time you screamed louder at Mr. Jackson, didn’t you?

A. Well, that’s what I wrote, but that’s not what I did.

Q. And you slapped Mr. Jackson, didn’t you?

A. You ever see a coach with a football team getting ready to leave; ok? And I created..

Q. Sir, could you please answer my question? Did you write you just slapped Mr. Jackson ?

A. You want a “yes” or “no” that doesn’t tell the story of what actually happened? What do you want? Ok. When we were I know what you want.

Q. Did you write that you just slapped Mr. Jackson ? “yes” or “no”?

A. No.

Q. Ok. You didn’t write “I just slapped him”?

A. Yeah, I wrote that.

Q. Ok. But that’s an exaggeration again; right?

A. No. I slapped him.

Q. But you slapped him, oh, like a nice slap, like, oh, come on, let’s go, and then you screamed. Louder than you did at Arthur Cassell; is that correct?

A. Here’s what I did; ok? This was a very tense situation. And, you know, frankly, I created the tension in that room; ok?

Q. Sir, I …

A. Because I was so nerve-racked, ok, the time slipping away, and his career slipping away; ok?

Q. When you wrote “I just slapped him,” was that an exaggeration?

A. Nah. I slapped him on the butt.

Q. Ok. And when you screamed louder than you did at Arthur Cassell, and that time the windows shook in your office, was that another exaggeration?

A. At the time it was an exaggeration, yes.

Q. So that’s another exaggeration?

A. It was an exaggeration.

He slapped him and now says that it was on the butt. However slapping a 50 year old man on the butt is also an insult, only not as spectacular and open as a slap in the face.

And it wasn’t on the butt – Randy Phillips is lying again. If it was some ‘nice’ and friendly slap as Randy Phillips says it was, he would not have written in his email:

  • “I just slapped him and screamed at him louder than I did with Arthur Cassell.”

No, guys,  unfortunately it was a slap in the face as a ‘friendly slap on the butt’ is not accompanied by that kind of screaming.

And judging by the force of his yelling I am also afraid that it was not a mere touch.

What’s also horrible about it is that Randy Phillips boasted of his feat to his surrounding.

Not only did he insult the 50-year-old man whose dignity, genius, fame and ‘selling capacity’ were to be respected and even awed at, but he wanted the employees of his company to know of the insult and humiliation he subjected Michael to. I wonder what looks they gave Michael when he was getting into their bus and how he felt at that moment and forever after.

Well, once Shawn Trell opened the hunting season for Michael by calling him a “freak” just prior to signing their contract, it was inevitable for this style to be upheld by everyone else at AEG.  This must have been the prevailing AEG approach towards Jackson throughout their ‘cooperation’ and this must have been the atmosphere in which all those rehearsals, negotiations, discussions were taking place. It simply could not be any different – when bosses give a nod to some outrage those under them lose their ability to behave decently and acquire the same  style too. Human nature, you know.

However conscience is a dangerous thing to discard and some day their meanness and lack of humanity will backfire at them, and all of it because they threw away their conscience as some unnecessary trash at the time when it was needed most.

I wonder how those in the media feel now that they are forced to come to terms with their conscience too. Their natural instinct tells them that they should report the absolutely abominable news that the top AEG guy slapped Michael Jackson, and give to it a proper assessment but they have to keep silent or justify Phillips’ actions by Michael being ‘drunk’ (which he was not).

I refuse to believe that none of them are appalled by the news. At least some of them should have some shreds of conscience left and it should be urging them to write about it as their duty calls on them to.

Poor journalists. They have to stifle their indignation and keep their mouth shut because they have to obey the instructions of their editors. They need to keep their jobs and feed their families, and bargaining with their conscience is the price they have to pay for betraying the truth.

Poor editors. They have to listen to the media owners setting to them the limits within which reporting about Michael Jackson is allowed. A ‘freak’ can be widely reported because it will only enhance the Jackson image portrayed by them earlier, but telling the whole truth about that abominable scene is out of the question. This unpleasant truth may undermine the whole building they have been constructing around Michael Jackson for too long – that  ‘he is the only one to blame for his troubles,’ and therefore any inside information about him being humiliated, bullied and harassed by someone like AEG is almost impossible to report.

However for some journalists freedom is evidently dearer. Richard Johnson of the New York Post, for example, impressed me by telling the truth as soon as it became known at the trial (unfortunately the headline of his article leaves much to be desired):

….To another business associate, Phillips wrote: “I haven’t pulled it off yet. We still have to get his nose on properly. You have no idea what this is like. He is a self-loathing emotionally paralyzed mess… I just slapped him.”

Phillips admitted, “I slapped him on the butt.”

And Charles Thomson went even further. Not only did he tell the truth about Phillips hitting Michael but he even expressed an opinion on the behavior of his colleagues. He called all this media silence utterly incriminating which it sure is:

AEG boss Randy Phillips admitted in court this week that he hit Michael Jackson because he wasn’t ready to go to a press conference. ‘Screamed at him so loud the walls shook’, then hit him.

I can find only one news outlet on Google News which is running this story. Every single other outlet on the planet seems to have left it out of their coverage. Utterly incriminating.

While  I was writing this post the first news of the slap finally appeared in some media outlets. All of them come under one headline as if copied from one source, which is evidently the article by Alan Duke ” I slapped despondent Michael Jackson”.

Out of the now infamous exaggeration Duke uses only that ‘despondent’ thing  and gives a rather detailed account of Phillips’ testimony, however he does not focus on the crucial fact of Phillips’ admittance that Michael was not drunk and thus gave absolutely no grounds for being treated that way.

So by now we have three journalists writing about this abominable scene and several more outlets reprinting Alan Duke’s story which is a sign of some improvement at last. All is not lost guys if we have three journalists brave enough to raise their voice in favor of the truth.

Randy Phillips’ testimony on June 5 is a complete revelation from the very start of it. For example, we learn that he ‘never read’ their contract with Michael Jackson and familiarized himself only with its summary prepared by Kathy Jorrie. This lie is intended to absolve Phillips of the atrocities their contract was filled with:

Q. Before Michael Jackson died, you never reviewed his contract with AEG correct?

A. Before Michael Jackson died? I did review the contract when I signed it before I signed it.

Q. Ok. So let’s play your deposition, sir.

Q. Ok. Now, your deposition was taken on January 17th, 2013; correct?

A. Correct.

Q. And then you signed under penalty of perjury on February 28th; correct?

A. Correct.

Q. So about six weeks later; right?

A. Correct.

Mr. Panish: ok. Let’s play the deposition.

(a video clip was played with the following testimony being said:) 

Q. Did you read the Jackson / AEG live contract in January of 2009? 

A. No.

Q. Never read that one? 

A. No. I read a summary of it, but I didn’t read the whole contract.” 

Q. Who prepared the summary you reviewed; sir?

A. Would have been Kathy Jorrie.

Q. Ok. When was that comprised for you, sir?

A. Prior to execution.

Q. Ok. So she where is the summary?

A. Where is the summary?

Q. Yeah.

A. Probably in my files. I don’t know.

The next passage confirms to us what we already know – AEG were dying to go into a deal with Michael Jackson but he was inaccessible to them, and the person who brought him to AEG was Tom Barrack. As you remember Tom Barrack set a deal between Michael Jackson and AEG as a condition for buying out the foreclosure note on Neverland. From the tone of AEG emails we understand that working with the man whom they called a “freak” behind his back was AEG’s most coveted desire:

Q. I’m handing you exhibit 8111, an e-mail chain. The top e-mail, June 22nd, 2009 see that before, sir?

A. Would you let me read it, please?

Q. Sure.

Q. Ok. Can you read for us first of all, you agree that Mr. Anschutz is a close friend of Tom Barrack; right?

A. Yeah. You asked me that already. I don’t know about friends, they were business associates.

Q. Ok. Why don’t you read what you wrote, sir?

A. Ok. In response to a request for tickets to one of Michael Jackson ‘s shows just trying not to take it out of context. I want to give it context.

Q. Sir, could you please…

A. “it would probably be tacky to not comp him since he is the real reason we have MJ tell him we have comp’d seats and offer him a suite at some hard cost charge. Phil a will be there, and they are close friends.”

Q. Ok. You’re referring to Mr. Barrack, aren’t you, sir?

A. Yes, I am.

Q. Ok. And you said,” Mr. Barrack is the real reason we have MJdid you say that, sir?

A. Yeah, I did. In context.

Q. And did you say him and Phil are close friends?

A. I did.

Q. And is “Phil a” Mr. Anschutz?

A. Yes.

The talk about making films and the agreement Michael Jackson signed with AEG about film-making are a very important subject heavily underestimated by us up till now. In his testimony Shawn Trell said that AEG was to provide Michael with opportunities for making three films but the project was dropped as “no one was interested” though they allegedly were making enquiries about it here and there.

However Randy Phillips says that if a 3D Thriller film had been made it would have been a big commercial success. The fact that AEG did not properly fulfill their duties under that agreement shows that all that talk about film-making was just a trap to lure Michael into the AEG deal, and once he was in it they simply dropped the film subject as an unnecessary one:

Q. Ok. Now, you knew that Michael Jackson was interested in making films; correct?

A. That is correct.

Q. And part of the negotiations for the tour agreement was including a film development agreement?

A. Yes.

Q. I want to show you exhibit – defense exhibit 12,246. It’s a development agreement for films. Is there any question in your mind Mr. Jackson didn’t want to make films?

A. Didn’t want to make films?

Q. Right.

A. No. He very much wanted to make films.

Q. Did you think he would be good at it?

A. I think “thriller” 3d would have been a winner. I’m not sure what other products he had in mind.

Q. You thought he was one of the most creative people you ever met; right?

A. In the music business.

Q. And that he “thriller” 3d, you said “a winner.” you mean a smash, a hit?

A. In that terminology, yes.

Q. I mean, in the music business, you kind of say blew it out; right? He’d blow it out?

A. For the jury’s sake, a commercial success, yes.

Q. Ok. And no question in your mind “thriller” 3d would be a commercial success and make money?

A. “thriller” live action 3d, yes.

Then the talk goes over to the subject of Michael being in a rehab in 1993 and Randy Phillips amazes us by saying that he never heard about it. You understood me right – everyone knows about Michael being in a rehab as he himself spoke about it on TV but Randy Phillips missed all of it and is learning about it from Panish only at this trial:

Q. And, sir, did you learn if Mr. Jackson went into substance rehabilitation, and that tour ended early?

A. No.

Q. You never heard that?

A. I don’t remember hearing it.

Q. Ok. And when’s the first time you heard that?

A. Just now.

However almost immediately after that we find out that Michael’s prescription medication use and alleged alcohol consumption were the subject of communication between the trio which was imposing the tour on Michael Jackson. Mr. Nanula from Colony Capital briefed Randy Phillips on media speculations in this respect and Phillips forwarded the email to no other than Tohme Tohme. By the way he called him a “doctor” in this email and drew his attention to ‘a lot of research’ done by a certain journalist. You may be interested to know that the journalist mentioned was Diane Dimond.

From Phillips’ deposition:

 Q. Exhibit 68 seems to be from Mr. Nanula forwarding you an article in the Sunday Independent  From December 7, 2008. Do you see that?

A. I see it. I don’t remember reading it.

Q. Ok. On the page that ends -6562, there’s a statement: ‘Jackson ‘s productivity could very well be suffering due to his alleged relationship with alcohol and prescription medication.’  Do you see that? 

A. Yeah. I see the paragraph.

Q. Ok. Somebody wrote that anyway; right?

A. Obviously. I’m reading it.

Q. Yeah. And you read it back at the time in 2008, didn’t you? 

A. I don’t remember reading this article at all.

Q. Ok. You wouldn’t … 

A. And I wouldn’t have put much credence in anything in the English press.

Q. Ok. When you know who Diane Dimond is, don’t you? 

A. I have no idea who she is.

Q. At least what she had quoted as saying is he’s had problems with alcohol and painkillers for  years. You saw that; right?

A. No.

Q. You see it now?  

A. I see it now. I didn’t see it then.

Q. And you we’ll put it up there this is forwarding the e-mail from Mr. Nanula; correct?

A. That is correct.

Q. Ok. And tell us what you wrote when you forwarded the article from Mr. Nanula that included references to drug and alcohol abuse.

A. I wrote: “doc, have you read these stories? This reporter did a lot of  Research. Rp.” 

From Phillips’ deposition again:

Q. Did you do anything between the time you received this article on December 8, 2008, to the time of Mr. Jackson’s death, to determine whether he had a problem with alcohol or painkillers? 

A. No.

Q. Or any other kind of narcotics or prescription drugs or just prescription drugs. We’ll leave it at that. 

A. No. I was strictly his promoter.

Q. Ok. You never asked Dr. Murray about that? 

A. No.

Now we are finally getting closer to the London press-conference and learn an interesting detail about the events prior to it. It turns out that it was already then that Michael was not on speaking terms with Tohme as he had arranged an auction Michael never allowed. Randy Phillips called the auction “stupid’.

By the way all the damages and losses under the auctioneer’s lawsuit had to be paid by Michael Jackson.

It is over here that the subject of being “drunk and despondent” and yelling at Michael is first raised. Phillips turns each word he wrote in his emails into a huge argument over their semantics. Now he says that yelling was an exaggeration and Randy Phillips just “raised his voice” – which seems to be a kind of a mantra with him as he repeats it to all the questions asked.

The version of a ‘hangover’ from the previous day was worked out by Phillips in the course of 30 hours of consultations with his lawyer and is another of his lies – a hangover from “last night” gives a much bigger smell than the actual drinking, and Gongaware said that MJ was not even smelling of alcohol though Michael actually hugged him and whispered into his ear about not having his glasses on:

Q. Now, sir, there was a press conference for the “This Is It” tour in March of 2009; is that correct?

A. Correct.

Q. And you were there; right?

A. Correct.

Q. And was it March 5th, to your recollection?

A. It was March 5th.

Q. And you and Mr. Jackson were late to that press conference; correct?

A. That is correct.

Q. Was it a miracle that the press conference even happened?

A. Pretty much, yes.

Q. Is that a “yes”?

A. That’s a “yes.”

Q. Were you late because Mr. Jackson was drunk and despondent?

A. By the time I saw him, he had a hangover from drinking. At one point he must have been drunk, yes.

Q. Sir, my question was: were you late because Mr. Jackson was drunk and despondent?

A. Correct.

Q. So that’s a “yes”?

A. That’s a “yes.”

Q. Ok. I’d like to show you exhibit 100 when you’re ready, let me know.

A. Ok.

Q. Ok. Let’s show that. Now, sir, this was one of those e-mails you were shown for preparing for your testimony?

A. Correct.

Q. Is this an e-mail you wrote on March 8th, 2009?

A. Yes.

Q. And is Mr. Morey a former manager of Mr. Jackson?

A. Yes, he was.

Q. Can you tell us the yellowed-out lines that I wrote? Could you read those that I’ve yellowed out? Could you please read those for me, sir, what you wrote to Mr. Morey on March 8, 2009?

A “MJ was not speaking to Dr. Tohme because of the stupid auction set up that MJ never agreed to until the day they left for London on the Gulfstream I chartered.”

Q. “Gulfstream,” is that an airplane?

A. It’s a jet.

Q. Is a jet an airplane?

A. Of course.

Q. So gulfstream is an airplane that you chartered to take people to London?

A. Correct.

Q. Who went on the plane?

A. To the best of my knowledge, it was Michael Jackson, his three children; hair and makeup artist whose name I can’t remember, and Dr. Tohme.

Q. Ok.

A. And Alberto Alvarez, security.

Q. And you didn’t travel with them?

A. No.

Q. Did you travel on your own?

A. Yes.

Q. Did you have your own Gulfstream?

A. No.

Q. You went commercial?

A. Yeah. I’m just a working guy.

Q. Mr. Anschutz didn’t lend you one of his planes to go?

A. No.

Mr. Putnam: objection.

Judge: I’m sorry. Didn’t lend him?

Q. Didn’t lend you one of the planes he uses?

Mr. Putnam: objection. Relevance, your honor.

Judge: sustained.

Q. Ok. So could you read the next line that you wrote, sir?

A. Yes. “the fact that the press conference even happened is a miracle, let alone getting through the unprecedented demands for shows that has caught us off guard.”

Q. Ok. Was that true, sir?

A. Correct.

Q. It was true that the press conference happening was a miracle; correct?

A. Yes.

Q. Now, sir, I’d like to play your deposition, page 59, 19 to 25; 60, line 20, to 62, line 12; and 62/15 to 63/25, regarding this issue. While they’re reviewing that, I want to ask you a couple questions.  Did you yell at Mr. Jackson?

A. Did I yell or did I shout?

Q. Did you yell? Y-e-l-l.

A. I raised my voice.

Q. Did you yell at Mr. Jackson?

A. I raised my voice.

Q. So the answer is you didn’t yell at Mr. Jackson?

A. I think when I wrote that, I was exaggerating.

Q. Sir, do you know what it means to yell at someone?

A. Yes.

Q. Did you yell at Mr. Jackson ? “yes” or “no”?

A. In the two and a half hours that this all took place, ok, it’s very hard if you take it out of Context, the answer is not going to make any sense, anyway.

Q. Sir….

Mr. Panish: your honor, could I ask that he answer the question?

Judge: yes.

Mr. Panish: it’s a very straightforward question.

Judge: just “yes” or “no.”

Q. Did you yell at Mr. Jackson ? “yes” or “no”?

A. Matter of interpretation.

A. At the time, I felt like I may have screamed. I just raised my voice.

A. I can’t answer the question that way.

Mr. Panish: your honor, I think it’s a pretty straightforward question

Judge: I can’t force him to answer it.

Mr. Panish: it’s “yes,” “no” or “I don’t remember.”

Judge: the answer is what the answer is.

Q. So you can’t answer the question; right?

A. No more than I just did. I raised my voice because it was a very tense situation towards the end of getting him ready to leave, and we were two hours late.

Q. So you will not admit that you yelled at Mr. Jackson or screamed at him; correct, sir?

A. I will admit that I raised my voice, and I got agitated towards the end of this period of time because we were so late for this press conference.

Q. Ok. Let’s play the deposition and see what you said at your deposition about this.

Q. All right. Mr. Phillips, exhibit 6 is a an e-mail that was produced by AEG live in this litigation, first from Mr. Morey to you, and then you responding to Mr. Morey. You see that? 

A. I’m reading it right now.

Q. My question is simply, is this an e-mail you got from Mr. Morey and an e-mail you responded to Mr. Morey? based on the headers, 

A. Yes.

Q. Ok. And it was produced by AEG live. You see the production stamp at the bottom; right?

A. Right. 

Q. There’s some language up at the top that talks about that you you wrote the top of this; correct? 

A. That is correct.

Q. And you wrote: ‘MJ was not speaking to Dr. Tohme because of this stupid auction he set up that MJ never agreed to”.

A.  Correct.

Q. Is that what you were just telling us about, the Julien’s auction?

A. That is correct.

Q. And then there’s language about the day they left for London. Is that the press conference for the ‘this is it’ tour?

A. That is correct..

Q. Then you wrote: ‘the fact that the press conference even happened is a miracle.’ do you see that?

A. I see that..

Q. What did you mean by that? 

A. To the best of my knowledge, at the time, the fact that Dr. Tohme and Michael were not in constant contact with each other, and we were dealing with Dr. Tohme on the logistics of the press conference and that that’s what I meant. I had to rely on Dr. Tohme to bring Michael and Michael for Michael ‘s participation in the press conference, and if they were estranged, I had no one to deal with.

Q. Was there a problem, Mr. Phillips, with Mr. Jackson’s appearance at the press conference that day? 

A. Are you talking about when he went to the microphone and was photographed?

Q. Well, I was thinking, actually, really, hours before going to the microphone and being  photographed. Did something unusual happen? 

A. We were late.

Q. Why? 

A. To the best of my knowledge, based on statements made to me by Dr. Tohme, Michael was scared of the reception he was going to get because he hadn’t been in the public eye in so long and that he might be hung over.

Q. Hung over?That’s what Dr. Tohme told you? 

A. Correct.

Q. But you didn’t see that yourself? 

A. At one point during the afternoon, I went into the room as Michael was getting prepared, and he seemed a bit ‘hung over’ would be I mean, I’m not an expert and I don’t drink, so I’ve never been hung over, so it’s just an observation.

Q. Well, my hunch is, in 30 years in the music industry, you may have seen somebody hung over at some point. No? 

A. Actually, no.

Q. How about drunk people? 

A. Yes.

Q. Ok. Was Mr. Jackson drunk? 

A. No. Not to the best of my knowledge, no.

Q. Ok. Was he despondent? 

A. No. 

Q. Now, sir, you testified there that Mr. Jackson was not drunk and he was not despondent, correct?

A. There? Yes.

Let me break this Randy Phillips’ theatrical performance and note that when the media bombards us now with headlines like “AEG exec says he was drunk and despondent” it is nothing but an intentional lie because at this stage the media is absolutely obliged to know that all AEG bosses said that that story was an exaggeration which in back translation from the AEG language means that it was a LIE.

Randy Phillips continues with his stories and like all others at AEG surprises us by not knowing why his immediate boss Tim Leiweke was fired. For some reason they are not allowed to talk about it and for the same reason our curiosity about it is only growing – no atrocity is bad enough for AEG, so what could Leiweke do to make Anschutz  fire him?

Q. Is that one of the 30 e-mails you reviewed in the over 30 hours of preparation you did with your lawyers?

A. That is correct.

[..] Q. Ok. Let’s look at the bottom. This is March 5th. Is that the day of the press conference?

A. That’s correct.

Q. Ok. Why don’t you read for us by the way, who are you writing this e-mail to?

A. To Tim Leiweke.

Q. And refresh my recollection. Who is Tim Leiweke?

A. Tim Leiweke was the CEO of AEG

Q. And is that one of the people who you directly reported to?

A. Yes.

Q. And would you say that he’s in charge of all the AEG operations here?

A. Correct.

Q. At that time?

A. At that time, yes.

Q. And he’s no longer with the company, and you don’t know why he left, and you never talked to him about it; right?

A. About why he left?

Q. Yeah.

A. No.

Q. You don’t know whether Mr. Anschutz fired him?

Ms. Stebbins: objection. Relevance.

Judge: overruled.

Mr. Phillips: I do not know why he left. We were told, all of us at the company, to not engage in discussions about that. But Tim is still a very good friend of mine, and he has a very big job now.

Q. Who told you not to discuss that?

A. Uhm, Dan. And just, it’s not something for us to engage in speculation about, the other executives.

Q. Sir, you said you were specifically instructed not to discuss why Mr. Leiweke left the company; correct?

A. With Tim, correct, yes. Nor did Tim discuss it with us.

Q. Sir, I’m only asking about you just told us that you were specifically instructed not to discuss why Mr. Leiweke left the company with anyone; correct?

A. Correct.

Q. And was that an e-mail that you received?

A. No, no.

Q. Was that a meeting?A. It was a conversation.

Q. Who was present when the conversation occurred?

Ms. Stebbins: your honor, I’m going to object to relevance, this entire line of questions.

Mr. Panish: goes to Mr. Leiweke’s bias as a witness and credibility.

Ms. Stebbins: your honor, this has nothing to do with this. The case is about the negligent hiring of Dr. Conrad Murray in 2009, not why Mr. Leiweke left the company in 2013. And Mr. Phillips already testified he doesn’t know why Mr. Leiweke left the company.

Judge: overruled.

Q. You remember the question after those objections?

A. How could I forget? Ok. They, Tim and Phil Anschutz had a disagreement, I’m sure, ok, and whatever it was, they mutually decided that it was time for Tim to move on. That’s all we know.

Q. That wasn’t even my question, sir.

A. No. I’m trying to answer your question.

Q. Ok. So he was fired?

A. You can say he was fired; ok? That doesn’t make it true….

A long discussion follows about Phillips not knowing why Tim Leiweke left. Dan Beckerman is the new CEO of the AEG parent organization and is the new boss of Randy Phillips.

To his predecessor Tim Leiweke Phillips said that he yelled at Michael so loud that the walls were shaking. Now he is refuting each word said in that email – he did not yell, he just raised his voice and was just ‘a little firm’ and ‘more affirmative’ than usual. The word ‘scary’ was an over-reaction and the reason for being ‘affirmative’ was because they were waiting for a certain item of clothing for Michael and the wait was taking too long.

You will agree that being late for the press-conference because they were waiting for a certain item of clothing is a decidedly different version from the previous explanation.  Assuming that now Randy Phillips is finally telling the truth this is how big a difference between the truth and lies might be in case we deal with people like AEG.

I wonder where the media is now and why they are not printing their stories under correct headlines: “AEG exec waited for two hours for a piece of clothing for MJ” or “AEG exec was kidding about MJ drunk and despondent” or “AEG exec says ‘scary’ and ‘yelling’ were an over-reaction”. Why indeed don’t we see any headlines like the above?

Q. Why don’t you read us what you sent to Mr. Leiweke at 5:49 p.m. London time.

A. I said: “MJ is locked in his room drunk and despondent. Tohme and I are trying to sober him up and get him to the press conference with his hairdresser/makeup artist.”

Q. Now, sir, just one second. Let’s go up to the next e-mail that Mr. Leiweke wrote you back. He wrote back, looks like, two hours later; right? Approximately?

A. Yeah. 7:29.

Q. Yeah.

A.“Are you kidding me?”

Q. He wanted to know if you were pulling a gag on him; right?

A. No. I think he just felt that it was incredulous that this was happening at this time.

Q. Ok. What did you write back? Let’s see what you wrote back to him in response. And you wrote this now at 7:33. So if we advance it eight hours help me out. What time would it be? You’re a numbers guy.

A. I’m the numbers man? Ok. It would make it 5:33 in the afternoon.

Q. London time?

A. Correct.

Q. Ok. So read to us what you told your boss, Mr. Leiweke.

A.“I screamed at him so loud the walls are shaking. Tohme and I have dressed him, and they are finishing his hair, and then we are rushing to the 02. This is the scariest thing I have ever seen. He’s an emotionally paralyzed mess, filled with self-loathing and doubt now that it is how time. He is scared to death. Right now I just want to get through this press conference.”

Mr. Panish: all right. Now, I want to play what you testified at your deposition. Page 64, 1to16, and page 64, 22, to 65 64/22 to 65/21. Did I already play that? No, I didn’t. Is that ok?

Mr. Putnam: (no response.)

Mr. Panish: ok. You can play that. (A video clip was played with the following testimony being said:)

Q. Did you yell at him? 

A. At some time during the afternoon, I you know, the word ‘yell’ might be a little bit extreme, And I might have used it to describe it. But I at one point it was taking so long, we were waiting  for him to get ready, and there was one item of clothing that he was waiting for, and time was ticking away, and I got a little louder and a little more affirmative than I had been in dealing with him up till then.

Q. Did you yell at him? 

A. I raised my voice. I was a little firm.

Q. You were a little firm? 

A. Yeah.

Q. Ok. Was there anything you saw that afternoon before getting to the press conference that scared you in terms of Mr. Jackson ‘s condition, behavior? 

A. Yeah. Well, you know, the word ‘scary,’ in looking back at it, probably is an overreaction to what was going on that afternoon, the fact that we were late for the press conference. And, yeah, when you have a press conference to announce the comeback of the greatest star in the world, and he’s running two hours late, and he appeared to be somewhat hung over, yeah, I would say I’m not sure ‘scary’ looking back, if I’d use the word scary or really more concerned.

Q. And did you conclude, based on what you saw, that Mr. Jackson was an emotionally paralyzed mess? 

A. That was a description that I used to describe what I encountered, what my observation was.

Q. You know what I’m talking about; right? 

A. Yes.

Q. You send an e-mail to Mr. Leiweke? 

A. Yes.

Q. So you said in the e-mail he was drunk; you said in the deposition he was hung over; right? And now you’ve told us he was drunk; correct? Is that right, sir?

A. It’s not a “yes” or “no” answer.

Q. All right. Did you testify in…

A. Do you want the truth, or do you want what I testified?

Q. You want to ask me questions? I just played your testimony, sir, didn’t I?

A. Correct.

Q. Ok. Is that the truth, what you said in your testimony?

A. I was responding to what Dr. Tohme had told me, and I was relaying that message.

Q. Sir, were you telling the truth in the deposition that I just played?

A. To the best of my recollection, I was, yes, sir.

Q. So is it so the truth, were you telling the truth? “yes” or “no”?

A. Yes.

Q. Ok. Were you telling the truth in this e-mail?

A. The e-mail?

Q. “MJ is drunk and despondent.” Were you telling the truth to Mr. Leiweke when you wrote that? “yes” or “no”?

A. I was relaying what Dr. Tohme had told me.

Q. Do you say that Dr. Tohme told you that MJ is locked in his room drunk and despondent?

A. No, because these things everything was happening so fast, it’s all merged together in one e-mail.

Q. I see. I see. So, really, if you knew lawyers were going to ask you about this, you wouldn’t have wrote it this way; right? You would have written it differently?

A. No. At the time I didn’t have any time. I wrote it as fast as I could write it.

Q. All right, sir. And you must have yelled pretty loud or screamed pretty loud to make walls shake?

A. It’s an expression, exaggeration.

Q. Do you have a tendency to exaggerate, sir?

A. I knew you were going to ask that. No. No, I don’t.

Q. This is the only time you’ve ever exaggerated anything relating to Michael Jackson ?

A. No, no. Mr. Panish, in our lives, I’m sure we all exaggerate at times; ok?

Q. I asked you, sir.

A. Yes.

Q. You want to keep talking?

A. No. Well, actually, Mr. Panish, if you would allow me to, I would like to explain the circumstances of what was going on that afternoon.

Q. I’m getting to that right now.

A. Ok.

Before we reach the final scene there is one more detail worth mentioning. It turns out that Randy Phillips was spreading  lies about Michael being “drunk and despondent” among everyone around Michael thus creating the atmosphere of contempt, ridicule and unsafety for the man. He told his big story to everyone  – Gongaware,  a certain Loeffler, his partner in a different company, the transportation guys who were waiting for them downstairs,  “a few people in the company” – in short, to everyone in AEG who could only hear and listen.

By the way it was Loeffler that Randy Phillips put into Michael’s dressing room. Michael asked his friends what the man was doing in his room and was deeply distrustful of him:

Q. Did you tell anyone else besides your boss, Mr. Leiweke or, as you call him, your direct report that Mr. Jackson is a self-loathing, paralyzed mess?

A. I probably had a conversation with Paul Gongaware who was at the 02 at the time, where I may have used similar terms. I had an associate of mine who was downstairs getting the transportation ready. I may have said that to him. I’m you know, there were probably a few people in my company that I may have said that to.

Q. Ok. First of all, Mr. Loeffler, is he a friend of yours?

A. Loeffler.

Q. Is he a friend of yours?

A. As is Mr. Gongaware, yes.

Q. Does he go over to your home?

A. Does he go over to my home?

Q. Yes.

A. He has been to my home, yes.

Q. I mean, he was at your home does he live there at your home?

A. No. He lived in Utah with his wife and kids.

Q. Well, he was at your home the day that Michael Jackson died, wasn’t he?

A. No. We were… he was in my car. We were at the dry cleaners. We were on the way to the StaplesCenter.

Q. You still work together?

A. David and I? Yes.

Q. And you still have your management company?

A. Yes.

Q. And what is your management company called?

A. Phillips digital media.

Q. So in addition to being the CEO of AEG live, you have another job where you run a management company; is that right?

A. It’s a small management company, yes.

Q. Is Mr. Loeffler a partner with you in that business?

A. Yes, he is.

Q. Did Mr. Loeffler ever work on the “This Is It” tour?

A. He was with me in London during the press conference because he was producing he and I were both producing Lionel Richie’s European tour. So he was there with me then, so he was helping me out at the press conference. And then I asked him to do me a favor when we were in rehearsals the last two days, June 23rd and 24th, at the Staples center.

Q. Now, could you answer my question, please?

A. Yes, I did.

Q. Was Mr. Loeffler working for AEG live in conjunction with the “This Is It” tour?

A. No.

Q. So he wasn’t being paid?

A. No.

Q. And the favor was, you stationed him in Mr. Jackson ‘s dressing room for the last two days, correct?

A. I stationed him?

Q. Yeah. You had  him stand with Mr. Jackson ?

A. No.

Q. Did you ask Mr. Loeffler to go into Mr. Jackson ‘s dressing room the last two days?

A. No.

Q. Ok. And he wasn’t in Mr. Jackson ‘s dressing room, was he?

A. No, he was. I was I asked him to help

Q. There’s no question pending, sir.

A. No, I know. I know. But you want to color something that isn’t the

Mr. Panish: excuse me, your honor. He’s just talking.

Judge: give the full answer.

A. Ok. Mr. Loeffler, ok, was not stationed, the way you put it, in Mr. Jackson ‘s dressing room. Mr. Ortega, our director, asked me if I could get somebody to just ask Michael if he needed tea, water, food, things like that, because he had a staff of four bodyguards and an assistant, and no one seemed to care about what his needs were. So the person who was going to do that on the tour, Brigitte Segal, was in London scouting out houses for him for the 02 run. She was going to be back that week. I asked Dave to do that for me so – because Michael knew him, it was not a strange face; ok? And believe me, ok, he was not a spy. There was nothing in that dressing room I needed to know.

Q. Anything else you wanted to say, sir?

A. No. I’m glad I got a chance to say that. Thank you.

Q. You’re welcome. Brigitte Segal, was she overlooking housing for Conrad Murray, also?

A. No. I don’t know if Dr. Murray was going to stay in a hotel, he was going to stay at Michael ‘s house. I had no idea what arrangements were being made for him.

Q. Wait a minute. You don’t know that Brigitte Segal had been finding houses for Dr. Murray,sir? You never heard that?

A. No.

Q. You never heard that she showed Dr. Murray properties where he could live in London?

A. I know you think I am an omnipotent being in this job

Q. Excuse me. Just answer

Judge: he’s answering.

They go on talking in the same manner about Brigitte Segal securing housing for Karen Faye, Alberto Alvarez, Conrad Murray, Michael Amir, Rosalyn Mohammed, Michael Bush, Frank & Miko. Let me remind you that AEG made Michael financially responsible for all these housing arrangements.

Now we are getting closer to the final and truly dramatic scene:

Q. Sir, you know what it means to sober someone up?

A. To sober someone up? I assume if they’re drunk, that means to get them sober.

Q. When they’re drunk, you try to sober them up; right?

A. Correct. That’s what I’m assuming it means, yes.

Q. Well, sir, you wouldn’t try to sober up someone who had a hangover, would you?

A. I don’t know. I don’t drink.

Q. Ok. Well, let’s see what you say about that. Let’s look at 93-1 again, in the bottom. And you told me that Dr. Tohme told you all this information about Mr. Jackson being drunk; correct?

A. Correct.

Q. But you and Dr. Tohme were trying to sober up Mr. Jackson , weren’t you?

A. What I told you, and what I testified to prior, is that this e-mail, it’s kind of compressed, the two events, that makes it sound like it’s all at the same time.

Q. Ok. Could you answer my question, please? Were you and Dr. Tohme trying to sober up Mr.Jackson ? “yes” or “no”?

A. Yes.

Q. Did you write that in this e-mail? “Tohme and I are trying to sober him up,” meaning MichaelJackson ?

A. And I used the word “sober.”

Mr. Panish: excuse me, your honor. Can he answer the question, please?

Judge: ok. Listen to the question, and answer. Your attorney will have an opportunity toask you questions to clarify something. I mean, if I don’t if you have an explanation, I want you to give an explanation.

Mr. Phillips: I understand.

Judge: focus on the question.

A. I understand. The answer is “yes.” The answer is “yes.”

Q. Now, let’s go back to exhibit no. 270 no. 2780, and let’s start at page 3,which I showed you earlier. You have it there in front of you. And this is with your colleague, I’ll call him, Loeffler. Did I get that right?

A. David Loeffler, yes.

Q. Mr. Loeffler?

A. My colleague.

Q. Is it fair to call him your colleague?

A. And friend, yes.

Q. And you’re telling Mr. Loeffler that you and Dr. Tohme threw Michael Jackson in a cold shower; right?

A. Correct.

Let me break his narrative once again. So Michael was not drunk and there was absolutely no need to “sober him up”, but nevertheless they put him under a cold shower and actually threw him there?

For what purpose I wonder? To show their power over him? To intimidate him? And does the fact that they thought that they were sobering him up but were mistaken in their assumptions make it any better?

If some people come to your place and throw you into a cold shower, what will be your actions, dear reader? A sheer stranger violates your privacy, touches you all over, drags you into the bathroom and throws you in your clothes into a cold shower? Or did they strip him naked before that? And will this version be any better if this is indeed what they did to Michael?

The first person to voice an opinion about this outrage was Phillips’s friend Loeffler. He replied to Phillips after reading his email – “your crazy”. However Phillips was evidently enjoying himself so much that upon seeing Loeffler’s reply he chose to correct his grammar – so this is how “nerve-stricken” he was:

Q. And then, go to the page before that so you and Mr. Loeffler were communicating back and forth, weren’t you?

A. By e-mail.

Q. Right. By e-mail. By Blackberry, actually. You had a Blackberry?

A. That’s correct.

Q. And then he tells you, you’re crazy; right?

A. I’m just looking for that in the e-mail.

Q. Yeah, sure. Just look at the screen. Maybe that will be better for you. He says, “your crazy.” look like he sent it from a Blackberry, too.

A. Yes.

Q. And then you two minutes later, approximately, three minutes, later you correct him; right? While you’re dealing with Mr. Jackson , who is drunk and despondent, you’re correcting Mr.Loeffler on his grammar; right?

A. It’s a habit I tend to have.

Q. But while all this was going on in a short period of time, and everything was jammed together, and you’re so busy, you’re correcting your friend on his grammar; correct?

A. That’s the role I play with most of my executives as a mentor, yes.

Q. Ok. Then by the way, did you hit Mr. Jackson?

Here it is. As if all that madness was not enough for us, now we learn that in addition to stripping Michael of all dignity and throwing him into a cold shower Randy Phillips actually HIT Michael.

Phillips wrote about it in an email because he wanted to inform the transportation guys how he finally managed to get Michael going.

So Michael was taken from the shower, given some clothes and at this point he yelled at him so that the walls were shaking and then he slapped him too – evidently as the final argument in favor of going to the news conference?

To our amazement he also admits that it was he who was creating the tension in that room. So it wasn’t Michael who was the problem but actually Randy Phillips? So it was Randy Phillips who was an emotional mess full of arrogance and conceit?

Where are our media outlets with all their headlines? Why not say this for example: “AEG exec says he was an emotional mess” or “AEG exec slapped Michael  in a hysterical whim”?

Q. Ok. Then by the way, did you hit Mr. Jackson?

A. No.

Q. Ok. Well, let’s see what you said at the top of that page at 712/17. Why don’t you read what you said, sir?

A. This is in response to getting the transportation set up. I said:“you  guys are going to follow US behind a 12-passenger bus back there. I just slapped him and screamed at him louder than I did with Arthur Cassell.”

Q. Who is Arthur Cassell?

A. Arthur Cassell is one of the most annoying human beings on the face of the earth. He committed Lionel Richie to a date at a police department fundraiser for the LAPD, and Lionel never had agreed to do it, and I had to get him out of it. So on the phone with Mr. Cassell, I did actually scream loud enough to shake the wall, the glass walls of my office.

Q. But this time you screamed louder at Mr. Jackson , didn’t you?

A. Well, that’s what I wrote, but that’s not what I did.

Q. And you slapped Mr. Jackson , didn’t you?

A. You ever see a coach with a football team getting ready to leave; ok? And I created

Q. Sir, could you please answer my question? Did you write you just slapped Mr. Jackson ?

A. You want a “yes” or “no” that doesn’t tell the story of what actually happened? What do you want?

Mr. Panish: your honor, could he answer the question? And the question was – 

A. As to the slap. I’m going to get to it.

Judge: you know what? Only one person can talk at a time, so probably best if you can listen to the question and answer what is asked.

Q. Ok. Your lawyer, who you trust, will get to ask you whatever you want; ok?A. Ok.Q. Can you try to answer mine now? It’s my turn. I get to ask questions on behalf of my client;ok?A. Be my guest.Q. When you wrote “I just slapped him,” was that an exaggeration?

A. Nah. I slapped him on the butt.

Q. Ok. And when you screamed louder than you did at Arthur Cassell, and that time the windows shook in your office, was that another exaggeration?

A. At the time it was an exaggeration, yes.

Q. So that’s another exaggeration?

A. It was an exaggeration.

Q. Ok. Fair enough.

As regards Randy Phillips’ so-called exaggerations another one was told to Karen Faye when she shared with him her concerns about Michael Jackson’s health. Phillips’ words were full of contempt for Michael and  meant to show Karen that he was a good-for-nothing addict or alcoholic whose health did not even matter. His reply to Karen was that he had to ‘scrape him off the floor in his room”.

Now he says that he hears of it for the first time:

Q. Did you ever tell anybody that you scraped Mr. Jackson off the Floor in his hotel room in London before the press conference? 

A. Not to my knowledge.

Q. I’m sorry. When you say ‘not to my knowledge,’ is it your testimony that you don’t remember ever saying that, or is it your testimony that you did not say that? 

A. I don’t remember ever saying that.

Q. Ok. So it may have happened, it may not have happened. You’re not sure? 

A. I’m not sure.” 

So that press-conference was so precious to Phillips that for the sake of it he went as far as hitting Michael Jackson. But was that press-conference needed at all?

Absolutely not.

Four days after the conference Phillips’ friend wrote to him an email saying that by the time the press-conference was held half a million people had already registered for tickets so it looks like the press-conference did not matter. Surely Phillips was the first to know about it and now he says they could have simply released a press statement and that would be it.

Randy Phillips was stunned that they did not even have to make an effort to sell tickets (which was their only real obligation under the contract for which they charged Michael 10%) – all major media outlets came to them themselves, thousands registered for the tickets and all this was due to the magnetic power of the man whom he heavily undervalued and slapped four days ago:

Q. Ok. Do you have exhibit 102, sir?

A. Yes

Q. Are you involved in that e-mail chain?

A. Yes, I am.

Q. And this is from the C.O.O correct?

A. Correct.

Q.”Radio silent” means no communication?

A. Correct.

Q. And this is four days later?

A. Correct.

Q. You still in London now?

A. Yes.

Q. But you communicate by Blackberry; right?

A. Yes.

Q. And you say: “the press conference didn’t overwhelm me.” you don’t say that, he says that.

A. That’s correct.

Q.“I hear there are 450,000 registrants. So I guess the press conference didn’t really matter.” so he was not really impressed with the press conference; right?

A. No.

Q. Is that

A. That’s correct.

Q. Ok. So then you write back: “I don’t understand. 335 media outlets, front page in every major newspaper in the world, and the equivalent of over a million tickets sold in registrations….

Randy Phillips surely did not understand whom he had slapped four days before that, otherwise he would not have done it.

A week  before the press-conference Gongaware said to Phillips that they could do a press-conference without Michael and was perfectly right in this statement.  But his email had one more crucial thing betraying AEG’s intentions – he said that if they sold tickets Michael would be locked and would have not choice. Once the tickets were sold he would have to do the shows.

Doesn’t it perfectly explain why they set up 50 shows for him? They wanted to lock him and leave him no choice!

Randy Phillips’ deposition:

Q. Now, this is before the London press conference; right? This is February 27th, 

A. Yes.

Q. And the London press conference is March 5? 

A. Right.

Q. Mr. Gongaware wrote: ‘meanwhile, our play here is to not back off. We are holding all the risk. If MJ won’t approve it, we go without his approval.’  You see that? 

A. Correct.

Q. Did you agree with that tactic? 

A. Yeah. I’m not 100 percent sure what he was referring to.

Q. What do you believe he was referring to? 

A. That Michael was trying to back out of the press according to this, that he wasn’t going to get on the plane and go to London to do the press conference “and Paul ” that had been scheduled. ” and Paul recommended going ahead with the press conference and putting the tickets on sale, because ‘once we go on sale, which we have the right to do.

Q.  He is locked. He has no choice. He has to do it. Right?

 A. That’s what he wrote.

Q. Ok. Did you agree with that?

A No.

Q. Did you ever respond to this e-mail saying that you disagreed with it? A. “not that I remember.” 

Q. So Mr. Gongaware told you that: “if Michael doesn’t approve it, we go without his approval.” Correct?

A. The marketing collateral, yes.

Q. And he said: “once we go on sale, which we have the right to do, he is locked.” That meansMr. Jackson is locked in; right?A. That’s what he’s saying, yes.

Q. “and he has no choice. He has to do it.” Right?

A. That’s what Mr. Gongaware was saying, yes.

Q. And you never corrected those statements; correct?

A. I did to verbally to him, but not in e-mail.

Q. I’m sorry, sir?

A. I did verbally to him but not in e-mail.

Q. You didn’t respond to this and say, “don’t say that. We don’t want to pressure Mr. Jackson . He is not locked in.” you didn’t say that, did you?

A. That’s not my conversation with him.

Q. Did you write back to Mr. Gongaware and say, “Paul, hey, that’s not right. We don’t want to push him into this. We don’t need it’s not correct that there’s no time left to push this back”? Did you tell him that?

A. Well, we could have canceled the press conference we didn’t have to do a press conference.

Q. Did you write back and say, “Paul, we can back off now. It won’t be a disaster for us. There’s time left to push this back”? Did you write back and say that?

A. A. No. I had …

It’s not use reading it any further. We know well in advance what Randy Phillips’ answers will be like.

Of course they wanted to lock Michael and leave him no choice, and therefore set for him 50 dates. They knew he would have to do those shows after that.

In fact they never gave to him  any choice – from the very start of it. For Michael Jackson his cooperation with AEG started with no choice and a slap, and ended with no choice and a slap too, because all those AEG demands that he should rehearse were also a big slap in the face of Michael Jackson.

For his earlier tours he seldom rehearsed, and did not understand why he could not decide for himself, and had to waste all his remaining energy on those damned rehearsals. He had no such obligation to AEG and was not even obliged to explain himself to them.  And Phillips had no right to pressure him – either at rehearsals or that useless press-conference, let alone use such arguments like throwing him into a cold shower, yelling at him or giving him a slap in the face. I wonder how Michael could bring himself to talk to Phillips after all that.

It is impossible to imagine how he managed to dance, sing and even occasionally smile after that humiliation. It makes you cry, scream and mourn in silence, and then cry and scream about it again.

    It’s hurting so much, to read all this stuff but I’m only started but at least I want to believe that Michael no matter what did happen was surrounded by love (from his children & fans), he did what he loved the most – performing, giving smiles and shares love, I’ve been thinking a lot about what if he had a fine life it would be much easier for all of our hearts but he was Michael Jackson nothing is easy in his life, but I need to know that at least no matter what his last days were at least not that bad even in that situation, Michael loved life, he wanted to live and give so I am sure he had the plans how to protect himself he always “falls and raise” unfortunately it became his theme( I’m sure that he was excited to so show (even though he was exhausted and sick, but his health always was an issue for him so if they were responsible and could help him, everything would have been fine, he could survive and live a long life after even though concerts, I know that everything is much darker but I can’t, I need to think about positive areas otherwise it will make me depressed…. I just hope that he knew that he always is loved by his children & fans & family….and by rehearsing and performing he was in his safe bubble of art and love)

    Makes me sick i hope all of them get whats coming to them who run michael to the ground. Its very upsetting he had no say in anything my gosh. The evil randy phillip dont deserve to live who does he think he is slapping michael my goodness. So much evilism going behind this it production and to save his neverland ranch. I knew something was dodgey but never knew what it was. Thank you for this information. I will be still doing more research. This is it is an evil production.

    Hello. I adore Michael. I love him and this makes me so sad. I think that it definetly is possible that Michael was in fact slapped and yelled at during rehursal as well. I did recently write a nasty letter to both AEG and Sony. Both evil companies. Thank you for all of your hard work & research.

    What an evil group of bastards Michael Jackson was in “business” with. He should have had them arrested. It is a travesty what happened to this man. I wish his family would have found out about this assault while Michael were still alive. They would have beat the living daylights out of this Randy Phillips fool.

    Helena I stated my independent opinion and we don’t have to see the same people the same way. Michael was innocent and I don’t expect anyone to say otherwise especially if they worked for him. I appreciate it if people speak positively about Michael but that doesn’t mean that I can not criticize what I think is not ok. Neither do you. Not everyone who Michael ever met has the same significance to all but I don’t agree with applying double standards for different people which seem to be the second nature in the MJ fanbase. I respect and appreciate your and a few other bloggers work for Michael because it is done with integrity and thoroughness and for the right reasons, which cannot be said of some others. Excuse me if I am not impressed nor interested in those.

    Absolutely. The dates he gave are incredible – he spoke about 2005 or 2006 as if he doesn’t even know that almost immediately after the trial ended Michael left for Bahrain and they did not even see him after that. His level of ignorance about MJ is simply astounding.

    Yes, I am afraid I will have to post here an excerpt from lacienega’s blog Et tu, Brutus? which gives some idea about why some of those “interventions” were actually no interventions at all. The blog is called “Michael Jackson Rehab Interventions vs Family Concert Tours”:

    An excerpt:

    February 2007
    Raymone Bain, the former longtime publicist for Michael Jackson, has said there is no truth to rumors that have surfaced in the media since the pop star’s death, claiming that members of the Jackson family staged a failed intervention for the pop star in 2007.
    “It is not true,” Raymone told Access Hollywood’s Billy Bush in a new interview.
    Raymone, who filed suit against the King of Pop earlier this year for $44 million over claims he failed to pay her for her publicity services and more, said a meeting with the family took place in 2007, but it was business related.
    “I recall in February, there was a meeting with Mr. Jackson and his sisters and brothers about a concert,” she recounted. “There was a concert promoter who accompanied them there. That is the meeting that I… am aware of… I know nothing else about any other intervention.”

    Concert promoter Leonard Rowe stated that he had visited Michael with the family in February and April of 2007 in an attempt to have him tour with them and that they had been angry with Jackson for not agreeing.

    “On February 14th of 2007, I was in my kitchen fixing breakfast around 8am, and I received a call. I wondered who it could be that early, but it was too early for me to talk, so I didn’t answer. My phone beeped and I knew a message had been left. It was a message from Janet Jackson, Michael’s sister. She said, ‘Rowe, this is Jan. Would you please call me as soon as possible, it’s important.’ I said to myself, ‘I wonder what she wants this time of morning.’ I immediately returned the call and Janet answered. She was in Atlanta, and said, ‘Rowe, I’m in a little trouble; my tour has been cancelled by Live Nation, and I’m obligated to my band. They have blocked their time out this summer to tour with me. And now, if I don’t tour they will be missing income.’

    She then asked, if we could go out on tour and do twenty shows. I knew very well why Live Nation had cancelled. It was because at the time Janet was cold as ice. I did not believe she had the drawing power to tour at that time, but I could not help but think about how much Michael and her brothers the Jacksons had done for me earlier in my career. Because of my appreciation and gratitude, I knew I would do whatever was needed to help Janet. Even if it meant losing everything I owned and possessed, I truly would have done it. It was very painful to me, when later I found her to be unappreciative of my efforts. Being a black concert promoter in the concert business, ‘we have always had to learn how to take lemons and make lemonade.’ I told her to give me a few hours to think and I would call her back later that day. I pondered over her problem all afternoon, and I came up with three scenarios. I knew Michael had returned to the states. He was now living in Las Vegas.

    I later called her and said to her, ‘I’m going to Las Vegas, talk to Michael, and see if I can get him to get back with the brothers and tour. If he agrees to do that, I want you Janet, to be the opening act.’ Janet loved the idea. She asked me when I was going to Las Vegas. I told her I was going in a few days possibly Saturday. She asked if she could meet me there because she was flying back to Los Angeles, and would have her driver bring her to Las Vegas, so she could be there when I arrived that morning.

    I arrived in Las Vegas that Saturday around 5pm; we had decided that we were going to meet at her older sister, Rebbie’s house before going over to Michael’s. To my surprise, Jermaine, Marlon, Randy and Jackie were also there. After a short meeting we left to go over to Michael’s house about 7pm; when we arrived we were met by Michael’s security. We told them we were there to see Michael. He told us to wait one minute while he went inside to tell Michael that we were out there. When the guard returned he asked each of us to write down our names so Michael would know exactly who we were. After about fifteen minutes the security guard returned and led us into the house. When I saw Michael I could tell he was very nervous, I truly think he thought we were there for another reason. I noticed immediately that he was very thin. We went into the movie theatre room of the house to talk.

    I began to explain to Michael why we had come to see him. I told him that we wanted him to reunite with his brothers and to tour America. I told him Janet had agreed to be the opening act. I told him that I felt this tour would be highly successful. He said that he agreed that it would be. But he said, ‘I just can’t do it now, I have other things I am planning and working on.’ We stayed there for a few hours trying to persuade him. I think Janet was becoming somewhat angry with him. His final words to us were, ‘Maybe next year in 2008 I will be ready.’ To me this wasn’t bad because I would need the time to prepare for a tour of this magnitude, but Janet needed to work that summer. She had committed the month of July to her band, and she needed to fulfill that commitment. I could tell that Michael was becoming irritable and we decided to leave.”

    One more example:

    “Michael Jackson’s bodyguards from 2007-2009 reveal that when Jackson was in Vegas sometime in 2007 Randy and his on/off girlfriend and business partner Taunya Zilkie attempted to crash the security gate while demanding to speak to MJ, Zilkie would attempt to call this an “intervention”.
    “There was another occasion when Randy came to the house and crashed the security gate with his vehicle and came inside. And at the time, I didn’t know who he was and I drew my weapon on him and the first thing out of his mouth was ‘Get that thing out of my face or I’ll call the press,’” Bill Whitfield said, who said he put away his weapon when he realized it was Randy.
    Whitfield said Jackson was “not happy” and refused to see Randy.

    Taunya Zilkie, Randy Jackson’s public relations representative, says she was with him that day. She told ABC News that she and Jackson were at the Las Vegas house that day but never made it on to the property. And Zilkie denied that a gun was pulled.
    Zilkie said ABC News Randy Jackson went to Jackson’s home that day for an “intervention” but was refused entry into the house.
    The three bodyguards said that Randy tried to sneak in behind them as the doors to the gate were closing and hit the gate as he came though. Zilkie said Randy did not crash through the gate.”

    The bodyguards elaborated more to author Karen Moriarty about this incident,

    “From the open window of his car Randy yelled out, insisting on seeing his brother Michael. He shouted something about Michael owing him a lot of money.
    Whitfield, doing his job, confronted Randy politely but firmly. Randy responded by threatening to call the media … on his own brother.
    When the boss was informed of the nasty incident outside his front door, he was understandably upset. Whitfield sheepishly but thoroughly explained the events as they had unfolded. He seemed afraid … of his own younger brother. Who could blame him under these grim circumstances? For the next several days, there were no security details to run or errands to complete for the boss. Mr. Jackson secluded himself in the house without any word heard from him.”

    In her testimony for the AEG lawsuit Taunya Zilkie was forced to admit this had not been an “intervention” but that it had been an attempt to get money from MJ,

    “- Vegas event. Taunya says she and Randy went to see Michael for a business matter. Bodyguards did not open the gate so they waited until someone came in and they drove right behind them and parked at the front door and asked to see Michael. Bodyguards did not allow it, according to Taunya they were “belligerent and aggressive”. Randy later called Joe Jackson who came and was upset that the bodyguards was coming between brothers. Taunya says they wanted to leave but bodyguards was blocking their way. They let them out a few hours later. Taunya is asked about to explain the “business matter” they went to see Michael for, she replies “it was a financial matter”. She makes it clear that visit was not an intervention attempt. AEG asks “is it about Michael Jackson owing Randy Jackson money?” Taunya refuses to answer.”

    Michael knew about Gutierrez even before the Chandlers made their allegations. When Gutierrez approached Wade Robson and his mother in 1992 she listened to all the stories Gutierrez told about MJ being a “ped-le” and went back to Neverland and reported everything to the ranch manager Norma Staikos – Gutierrez is writing about it himself. Staikos contacted Pellicano and as VG says two months after his talk with Joy Robson Pellicano paid him a visit.

    Pellicano asked him why he was spreading all those stories about MJ and allegedly threatened VG:

    “Pellicano started to insult me. Just before he left, he said “We’ll be back! Consider yourself dead!” The only thing I could think to say in return was that he should not forget to buy my book. As I returned to my apartment, it was apparent to me that Michael Jackson was now aware of my investigation.”

    And the second time Michael “became aware” of Gutierrez was when he made up a story about a non-existent video of “molestation” and Diane Dimond disseminated it. Michael sued both of them for slander but she shifted all the blame to her “best source” Gutierrez. Gutierrez lost the case to MJ and was to pay more than $2mln in damages (but never did).

    So Michael was very much aware of Gutierrez, however I doubt that he could ever guess that the people behind VG were NAMBLA.

    Thank you, Helena, I fully agree with you. I am thankful for people like Dr. Treacy who told the media about Michael’s true nature at a time when everybody talked about MJ’s weird life and death. It was very necessary and we had been waiting for such statements. Every fan was happy when he defended Michael, and now he is regarded as unreliable? I don’t understand this. And he never disclosed information about the procedures he did for Michael. What he disclosed is only information to explain that Michael was no drug addict at this time.
    And LaPerruque also didn’t badmouth Michael, he just told the situation as it was at the time he worked for him.

    “Le Perruque Im sure is a sympathetic man and speaks highly of Michael. But ask yourself why he is called and not any other bodyguard or staff who were with Michael longer, closer and more recent than he has been. Because he is a former policeman and therefore a credible witness and because his sympathy towards Michael didn’t stop him from going to the media to talk about Michaels addiction.
    Not as an excuse but as a matter of fact , the difference with Randy Jackson is that Randy as far as I know never went to the media. People insinuate he did but it was never proven and it could have been anyone else in his entourage who was very close to him. If it had not been for the deposition and being under oath we would never have heard anything publically from Randy about druguse.
    Treacy also speaks positively about Michael . But he treated Michael for less than a year, yet he has been talking to the media about Michael more than any of his longtime doctors. Even Klein who is a mediawhore has not portrayed himself as intimate with Michael as he has.” – Sina

    Sina, I think it is absolutely unnecessary to bring others down in order to excuse Randy Jackson. LaPerruque did not go to the media during the trial, they approached him themselves hoping that a former policeman would tell them of something horrible he “witnessed”. But LaPerruque said he was so sure of Michael’s innocence that he would leave his own small children with him. So powerful a word in support of Jackson from a former deputy sheriff with 22,5 years of police work was invaluable at the time. And it is very good that LaPerruque is credible. Probably it cooled at least some crazy minds.

    And Patrick Treacy was so impressed by Michael when he was in Ireland that he simply could not stop speaking about him. He didn’t disclose any medical issues but said that Michael LIVED HIS FAITH. Treacy was so overwhelmed by Michael’s personality and then by his death that on occasions he was simply speechless. He almost worked on two different levels… There was an interaction over what you do but there was a continual thought process. People who reached a sort of spiritual enlightenment always have within themselves this continual wanting to help other people. It was fascinating to see it in Michael. I’ve had many experiences like that with him…

    12:15 Of course he was crucified. If there was the tabloid media present on Earth during the period of Jesus Christ two thousand years ago, they probably had branded him a ped-le as well.     After Wade Robsons deception and many others, I for one have stopped to praise the day before sunset with anyone who was part of Michaels entourage.
    Le Perruque Im sure is a sympathetic man and speaks highly of Michael. But ask yourself why he is called and not any other bodyguard or staff who were with Michael longer, closer and more recent than he has been.
    Because he is a former policeman and therefore a credible witness and because his sympathy towards Michael didn’t stop him from going to the media to talk about Michaels addiction. so he is a perfect witness. He was the one that brought the story in the media that Michael had collapsed and his children had to call 911, then making it sound like it was drug related. And that was when Michael was not even burried yet. And last year again he was on Dr Drew, a show specifically about addiction to talk about Michaels drugabuse.
    Not as an excuse but as a matter of fact , the difference with Randy Jackson is that Randy as far as I know never went to the media. People insinuate he did but it was never proven and it could have been anyone else in his entourage who was very close to him. If it had not been for the deposition and being under oath we would never have heard anything publically from Randy about druguse.

    Treacy also speaks positively about Michael . But he treated Michael for less than a year, yet he has been talking to the media about Michael more than any of his longtime doctors. Even Klein who is a mediawhore has not portrayed himself as intimate with Michael as he has. Treacy always says that he wants to protect Michaels privacy, yet tells about procedures he did on Michaels nose, when he administered propofol or not. I see that as a violation of patient-doctor privacy, the same as kleins cup peeing crap.
    He also told that Michael would ’take’ expensive creams from his office and sneak them in his pockets. Why tell such a story unless you want to create a certain picture of someone .
    I see Treacy as a paid helper who was of no significance in Michaels life but has perfectly promoted himself using Michaels name. Reason why he is not called as a witness despite pushing it: No credibility for either side.

    I am sure all along Michael knew about Victor Guitirrez,NAMBLA and of course the press that followed in their foot steps.Just imagine that all that would not have happened.
    Reading the testimonies last night, and that after I got carried away with all the videos and music,I had bad dreams about an ex-bf who very much had a love for money and some other negative attributes as well, not immediately dicernable.

    Yes, it is. I was the first who ever wrote about it. The full analysis of the contract was made several years ago in a series of posts. You can find the summary post about the contract in the menu on the main page.

    As to the terms of that contract let me say that all assets of the Michael Jackson Company LLC were indeed becoming AEG’s property under the Promissory Note, as all of them were put up as collateral in case Michael did not pay back his advances. This is why it is so important to determine how big those advances were. Physically they gave him only $5 mln. and this was relatively easy to return. But now they say that all production costs were also Michael’s advances and this is around $35mln and this was impossible to return within some 5 business days they allowed for it.

    So first the Michael Jackson Company LLC was to go, but since it did not have enough assets to cover the above sum, AEG would have sued Michael then to cover their “damages” including loss of profit and their O2 arena being unused on 50 dates (at least $85 mln. according to their official estimates).

    It is clear that Michael could not pay all that, so this was opening a road to acquiring his other assets, like the catalog for example, shielded by special Trusts. Without the court order AEG did not have access to the catalog, but if the court decided that it was needed to cover their “damages” they could.

    There was a special point in the Promissory Note which said that even if Michael declared bankrupcy he was still to pay to AEG the advances he received from them.

Judging by their impressive start with Mark Lester claiming that Michael was drunk and he is father of his children, and Wade Robson recalling being “molested” after twenty years of amnesia, we can expect a good deal more. I have a feeling that it was only a prelude. More actors will be coming in.

    Exactly, we have proof of Lester’s lies and see that Lester’s lies are working for the benefit of AEG by supporting their initial story, so bribery can be seen here almost with a naked eye.

    But if Mark Lester is promoting lies which suit AEG’s needs (naturally not just for free), this suspicious Randy Phillips’s talk about Mark Lester at the trial is also working in the same direction. Most probably it is meant to give prominence to this person, to remind everyone about him and his “great friendship” with Michael, and how “close” the two of them were.

    Phillips is a promoter, so he is promoting Mark Lester here, so that when he gets on stage he should get the maximum attention. Now it only remains to be seen when (or if) they will let Mark Lester go on stage with his lies about Paris.

    Note:
    Phillips remembers even the name of director of the movie. Did he hear it from Mark Lester when they were driving for an hour in the same van? I wish someone in court had asked him this question. He would have surely answered that they talked with Mark Lester about the film and he told him the name of the director. Only Dean Lean did not make that movie – he made the 1948 version and Lester’s was twenty years later and the director was different.

    All this talk about that movie is totally unnatural here, if you understand what I mean. It simply does not fit in, is out of place here, and therefore poses a question “Why”?

    “Michael passed out on the hotel bed. His doctor said he’d drunk two-thirds of a bottle of whisky and was paralytic,” he told the paper.

    Passed out? On the hotel bed?
    How could he even know about it? Alberto Alvarez was standing at the door and did not allow anyone in. Even Randy Phillips allegedly had a difficulty to get in as we know from his testimony. So was it from Phillips that Lester got this version and voiced it in April 2013?

    What doctor said it? There was no doctor around and even Phillips says there were only three of them – Tohme, Phillips and MJ, the children were watching TV in the next room, and somewhere around them there was a “make-up artist/nanny”. And Alvarez behind the door.

    And all this BS is said on the day of the opening statements at the AEG trial?
    And a week after that he would also claim that he is the father of Michael’s children? First of all of them, then only of Paris?
    And a few days after the AEG trial started Wade Robson would also suddenly wake up from twenty years of amnesia?

    You know, there is a pattern in all these strange occurrences and only one Ghost standing behind all this. And we know who it is. Look at who benefits from all these stories and you will know who is paying for all this.

    I know you can report suspected child abuse anonymously to an 800 number.I just thought of this, there may be some instance you can report to regarding gross medical practice. I know there are appointed doctors for this.I would not think you need to be a MD yourself, maybe a medical professional is ok. Could AEG be reported for abuse?

    Thank you all trying to get some truth out of this sorry mess.I am still without my own computer, so W/E are out and I am also pressed for time.A few things struck me: Thome and some wendy Thome buying a 5.8 mln house in Las vegas shortly after Michaels death.
    Peter Lopez death,no documents found realating to MJ & AEG and what about his computer?.And Murray´s confidentiality clause, needs to have writen permission from producer,?Any doctor has the right to consult with a specialist or someone in a superior position.There are particular doctors you report to if medical malpractice is concerned and you are always supposed to ask for help,naturally these doctors are also bound by confidentiality. But in Murray´s case?? He was malpractising on a continual basis and ofcourse he would have lost all moneys promised him.

    Let me make a small note on Mark Lester. His name was mentioned by Randy Phillips at least four times during his testimony –
    “Michael liked London because he had friends there – Mark Lester, for example.” “Mark Lester was in a van with us when we were going to a press-conference”, “I got to know Mark Lester because we had an hour and 10 minutes to get there”, “I booked seats for the Oliver Twist show the next night. Mark Lester was a child actor in the movie. He took his wife and daughter.., his kids to the show”.

    So Randy Phillips “got to know Mark Lester” and speaks of him as if he got to know Bill Gates? And he thinks it important enough to mention this guy at least 4 times in his testimony? I must be growing paranoid like Michael but am sure that all this repeated talk about Mark Lester is carrying a message . Considering that Randy Phillips does not remember the names of even his immediate colleagues who worked for This Is It tour, I can’t believe that he remembers and mentions this guy Mark Lester just for nothing. All that repetition of Mark Lester’s name is only meant to convey to the public that this person played a much more important part in Michael’s life than he really did.

    I think that Randy Phillips is preparing ground for a future scandal and we know what it is.

    Incidentally only a couple of days after the first testimonies started at the AEG trial, on May 5, 2013 Mark Lester suddenly resurfaced with a story about Paris Jackson being his daughter. As proof of it he said she looked like his daughter which is complete bullshit:

    Former Oliver! child star Mark – godfather to all Jacko’s kids – believes there is a “good possibility” he is their biological dad.
    The 54-year-old actor, who was Michael’s best pal for 30 years, donated sperm to the ¬superstar a year before the singer’s first child was born.
    Now Mark, who has not been ¬allowed to see Prince Michael, 16, Paris, 15, and Blanket, 11, since their father’s death in June 2009, has sent them a message, ¬saying: “I’m here, come and visit England, we’ll look after you.”
    Speaking exclusively to the Sunday People, Mark said: “After Michael asked me to donate sperm for him I completely forgot about it.
    “He was a great dad to them, brought them up and was brilliant with the kids so I just didn’t go there but there is obviously a good possibility (that I could be the biological father).
    “I wouldn’t have a DNA test without the children’s permission but when the children come of age, and it’s not far away, and they decide they want me to do it then I will. It is up to them.
    “I don’t want to tell them what to do. I just want to reconnect and be the godfather that Michael made me.”
    In his first interview for almost four years, father-of-four Mark says the resemblance between his 18-year-old daughter Olivia and Jacko’s girl Paris is striking.

    When Michael flew back to America, they kept a long-distance friendship. The singer often phoned Mark at 3am for a chat because he couldn’t grasp the different time zones.
    Mark said: “We ended up great friends. Michael had so many ¬people and security around him but had very few people that knew him really closely. I became one of those lucky few.
    “Michael lived in a bubble. He barely knew any famous person outside the music world.
    “He was once introduced to tennis player Boris Becker in Germany and had no idea who he was.”
    In 1991 Mark fathered his first child to first wife Jane. Just two years later another daughter Harriet was born and in 1995 he fathered his third daughter Olivia.
    Just months later Jacko called Mark with an unusual request.

    “Michael set it up for me to turn up to a clinic in Harley Street, London to do it. It was weird.
    “I went in a couple of times to donate but we never talked about it ever again.

    In February 1997, Jacko announced the birth of his first son with Debbie Rowe, Prince Michael.
    Paris followed in 1998 and Prince Michael II, also known as Blanket, arrived in 2002.
    As the children grew up, a paternity puzzle arose amid speculation Michael looked different to his three kids.
    He and his family vehemently denied claims the children were not his.
    Mark, who was made godfather by the superstar to all three kids in 2001, said: “While he was alive, I never ever thought the children were anyone else’s but Michael’s.”
    Mark’s children, including son Felix, now 13, became close friends with Jacko’s kids and the two families ¬became almost inseparable, spending school holidays and weekends ¬together. Mark, now a trained osteopath living in Cheltenham, Gloucs, said: “Every time Michael came to the UK, which was at least six times a year, I used to take my children to see his.
    “They always got on really well. Olivia and Harriet would play with Paris.
    “We always used to stay at an isolated cottage at the Cliveden House hotel in Berkshire. I even took the kids to his home in the US. We were like one big happy family.”

    Just three months after shakily ¬announcing the AEG Live tour at the O2, Jacko, who was reported to be £100million in debt, was found dead at the age of 50 after overdosing on painkillers and tranquillisers.
    His doctor Conrad Murray was later convicted of manslaughter and jailed for four years.
    Mark said: “When I heard the news I was devastated. I never saw him take any drugs. I managed to get to America for his memorial service and that was the last time I saw the children.”
    Two months after Jacko died, his friend Uri Geller mentioned to Mark that he could be the dad.
    Mark, who claims he had never previously thought about it, said: “Then I noticed the likenesses in my own children and his.
    “My daughter Olivia looks like Paris. People have also pointed out similarities between myself when I was younger and Prince.”
    But after hearing the claims, the Jackson family stopped answering Mark’s calls.
    He added: “I just feel it is really cruel that our relationship has just been cut off. It is not what Michael would have wanted.”

    500 new songs hidden at Neverland
    MICHAEL Jackson wrote around 500 songs and hid them at his Neverland home before he died.
    Mark Lester told how his superstar pal would often write ten times the number of songs for every album he produced – leaving hundreds unused ¬during his glittering career.
    Jackson, who made ten studio albums, is thought to have stashed them away in the recording studio at his sprawling California ranch.
    Mark said: “The next thing that will be found is Michael’s unheard songs. They must be in a vault somewhere at Neverland. He told me that when he wrote Thriller he wrote ten times more songs than were needed.
    “He did that with every album and would then filter out the best from the worst. I’m amazed no one has got their hands on them yet.
    “He couldn’t read or write music so whenever lyrics came to him he just had to quickly write things down. If he got a beat he would tap it out on to a portable tape recorder.
    “The tapes and words exist somewhere because I’ve heard some of them. One was about a mystery girl.
    “I don’t know if they were found when his estate was wound up. Either way they will be worth a bit of money.”

    “To all the people who were/are against this lawsuit do you still think this lawsuit should never have taken place? I for one am glad this trial is taking place AEG Randy Philips and company are being exposed, without this trial we would not have known how horribly they treated Michael. I would like to ask them was it Michael’s fault that he got thrown in to a cold shower like a piece of raw meat? Was it Michael’s fault Randy Philips slapped him? My reply to all those are HELL NO” – Truth Prevail

    If anyone is thinking that “it was Michael’s fault” let them go to hell. The e-mails betraying Randy Phillips’s actions and true attitude to Michael are irrefutable evidence against Phillips. At the trial he tried to minimize the devastating effect of those emails and presented some fairy tale story to explain his behavior. For the sake of accuracy let me also provide here the part of his testimony where he is explaining himeself.

    Frankly, I would even want to remember that scene the way Phillips describes it, but am afraid it won’t be possible as they fully omitted the slap and didn’t explain the throwing MJ under a cold shower part. It didn’t go with the rest of the picture so they preferred to simply “forget” it. So take this polished picture with a grain of salt please:

    Putnam: Okay. And so you went up to Dr. Tohme’s room. Was Mr. Jackson in Dr. Tohme’s room?
    A. No.
    Q. Who was in Dr. Tohme’s room?
    A. Dr. Tohme.
    Q. So just the two of you?
    A. Yes.

    A. I was in the room with him for about 20 minutes. I remember I was sitting on the couch watching CNN. And Dr. Tohme left and went into Michael’s suite.
    Q. And to leave to go into Michael’s suite, you said they were not connected. So did he have to leave his room and go into the hall?
    A. He went out the doorway to the right and into the double doors that was the entrance to Michael’s suite.
    Q. Michael’s suite?
    A. Correct.
    Q. And so he left you in his own?
    A. He left me sitting on the couch, watching CNN, yes.
    Q. At this point in time, how is your schedule? Are you running on time?
    A. I’m okay, you know.
    Q. What do you mean?
    A. I mean, normally I would I’m the kind of guy that gets to the airport two hours before the flight because I’m neurotic. I would have liked to have left about then because of London traffic, how famous it is and infamous it is. But we hadn’t left yet. And this was probably about 1:45 at this point.
    Q. So you’re starting to get a little apprehensive about this?
    A. A little bit.
    Q. But you’re by yourself?
    A. Yes.
    Q. All right. And did you have an understanding as to why Dr. Tohme left the room to go get Mr. Jackson?
    A. No. I assumed to help him get ready.
    Q. Okay. At that point in time did Dr. Tohme exhibit any signs that he might be concerned about being on time?

    A. Looking back at it, it seemed like an eternity, but he came back into the room about ten minutes later and said, “Michael’s just getting ready. He needs a little more time. Don’t worry about it. We’ll get out on time,” and that kind of thing.
    Q. And how much longer and did he leave again?
    A. Then he went back to Michael’s room.
    Q. So you’re still left in the room?
    A. Watching CNN, yes.
    Q. And how long were you there for this portion?
    A. This was about could have been 20 to 30 minutes.
    Q. Starting to get worried at all?
    A. I was starting to freak out.
    Q. Okay. Why don’t you tell me what you mean.
    A. Meaning that I know London very well, I’ve spent a lot of time there. The 02, what makes it great and makes it impossible at the same time, is that if you can take the tube, which is their subway, it takes 20 minutes from the west end to get there. Incredible. It’s on the east end of London. And the reason we ended up building the arena there is because there was no other land in London, and there was this big dome that the labor government had built, and they didn’t know what to do with it or how to program it, so it took an America company to show them how to do it. But the point is, going there, the traffic is mind-boggling, and I knew it was going to take us probably 90 minutes. And as it got later in the day, at 2:00, if we had left at 2:00 for a 3:00 press conference, it would have taken us 45 minutes.
    Q. Okay. So
    A. As you get later than 2:30, and as rush hour starts to begin, traffic starts to build up, that 45
    Minutes could easily become 90 minutes, two hours.
    Q. And so you said at this point you’re freaking out?
    A. I am completely freaking out, yes.
    Q. And you’re still alone?
    A. I’m still alone. But at this point I was no longer in the room watching CNN. I was in the hallway pacing back and forth.
    Q. All right. So at some point you freaked out enough to go out in the hall and start pacing?
    A. Yes.
    Q. And when you say “the hall,” the hotel hallway?
    A. Hotel hallway. I believe it was the first floor of Lanesborough.
    Q. And there are rooms, like doors to rooms, hotel rooms?
    A. Yeah.
    Q. And so you’re pacing?
    A. Uh-huh.
    Q. Why didn’t you just go up to his room and knock or go in?
    A. Well, Dr. Tohme came out and said to me that if I remember correctly, he said to me, “we have a little issue.”
    Q. Uh-huh.
    A. I said, “okay. What is that?” and he said to me, “well, Michael got drunk.” and I’m I think he said he was sobering him up. I don’t remember the exact terminology. But “we’re getting him ready, and we’ll get him ready, but we’re going to be a little bit late.”
    Q. How was your reaction to that?
    A. More anxiety.
    Q. Got it.
    A. Yeah.
    Q. Did he then go back in the room?
    A. He went back in the room.
    Q. Now, is there anybody stationed outside Mr. Jackson’s room?
    A. Yes. Alberto Alvarez.
    Q. Who is that?
    A. That is Michael’s security person.
    Q. So you’re pacing in the hall?
    A. Uh-huh.
    Q. And there’s a security guard outside of Mr. Jackson’s room?
    A. Correct. And you have to understand, that because you were talking about putting in context, all these e-mails on my blackberry and stuff. I had an ear piece in my ear, I had a Blackberry in my hand. I was typing e-mails at the same time I was talking and receiving phone calls from a lot of very concerned people at the 02.
    Q. And I’m going to show you the e-mails that you were asked about.
    A. Okay.
    Q. But before I do, when did you start e-mailing folks from did you do it from when you were in the room before you went out to pace, or did you do it when you were pacing? When did you start the e-mails?
    A. When I started pacing when I realized we were starting to have a serious time problem.
    Q. And that occurred before or after Dr. Tohme came out and said to you, “we might have a little problem”?
    A. Right after.
    Q. Okay. Now I’m going to show you these e-mails, if I can. That was exhibit 2733. So this is exhibit 2733 (indicating). It’s a 1-page document. It’s a couple e-mails between you and Tim Leiweke; correct?
    A. Correct.
    Q. And do you remember being asked about this e-mail?
    A. Yes, I do.
    Q. First one says: “MJ is locked in his room drunk and despondent. Tohme and I are trying to get him sober and get him to the press conference with his hairdresser/makeup artist.” where did you write that?
    A. I wrote that in the hallway prior to getting into Michael’s room.
    Q. So at this point have you seen him?
    A. No.
    Q. Why did you say, “he’s locked in his room”?
    A. Because I couldn’t get in the room. Alberto was at the door, and all my information was coming from when Dr. Tohme would come out to calm me down.
    Q. And “he was despondent.” why did you say he was despondent?
    A. That’s what Dr. Tohme said.
    Q. And it says: “Tohme and I tried to sober him up and get him to the press conference.” at this point were you trying to sober him up?
    A. No. I wrote that because I knew I was going into the room at that point, so I could type the e-mail and put the two things together of what I was going to be doing.
    Q. So this is the first e-mail you wrote, and you now left the room, Dr. Tohme’s room, and you’re in the hallway pacing; correct?
    A. Correct.
    Q. And you’re writing this to Tim Leiweke who is at AEG?
    A. He was somewhere in America.
    Q. Somewhere in America. You didn’t know where he was?
    A. No.
    Q. Still freaking out?
    A. Yes.
    Q. Okay. Is that why you sent the e-mail?
    A. Well, it didn’t make me less freaked out, but I figured I owed my immediate report an idea of what was happening, when I finally got the sense of what was happening.
    Q. And he responds, as you can see, “are you kidding me?”
    A. Yes.
    Q. It says, in terms of time and I know we’ve had this issue of time for a number of e-mails. But on this one, yours seems to have been sent at 5:49:18 in 2009; correct?
    A. Correct.
    Q. And we’re not sure what time zone that is, but we do know that whatever there is a time zone in which it’s 5:49:18; correct?
    A. Correct.
    Q. And then his response is 7:29:43. Now, that could be seconds later oh, I guess it couldn’t be because it’s 29. So this is sometime after, as much as an hour and a half; correct?
    A. Probably.
    Q. So he responds, but maybe not with the greatest haste. Would that be fair to say?
    A. Yeah, you could say that.
    Q. All right. But at this point in time you don’t know where he was?
    A. No.
    Q. All right. The did a time come when you did eventually go into Mr. Jackson’s room?
    A. Yes.
    Q. And how did that come to be?
    A. I went to the door, and I said, “Alberto, you’ve got to let me in. We’re really this is not good. This is a crisis situation. I have to get in that room because we have people waiting. We have press and all that.” and he could see by my face, it was not a time to stop me, okay, so he let me in.
    Q. Now, you said now, “this is a crisis situation.” was it a crisis?
    A. Well, that’s a term to me at the time, it was a crisis, because time was ticking away. I was sweating bullets, and this was a you know, we had over 3,000 fans, 350-plus news organizations with their crews waiting for Mr. Jackson. So, yeah, for me, at the time it felt like A. Crisis.
    Q. And let me ask you a question. You talked about this earpiece you had. Is that how you knew you had all these fans, all this press sitting here waiting?
    A. Well, the 25 phone calls in five minutes, yes.
    Q. Okay. So you’re in the hall, there’s phone calls from the venue, you’re pacing. There’s a guard at the door, and Mr. Jackson and his manager are behind that door; right?
    A. Correct.
    Q. You go in?
    A. I go into the room.
    Q. Tell us what happened.
    A. And Michael when I first walked into the room, Michael was sitting on the couch. And I think he had a like some kind of robe on. I don’t know if it was his robe or a hotel robe. He had a robe on and his pants, but he had a robe on. And I remember seeing a bottle of, what I thought was it was a clear bottle, so I assumed it was vodka, could be Gin, whatever. Bottle of booze on the foot of the couch.
    Q. Did that worry you?
    A. Yes. Yes.
    Q. How did he seem to you?
    A. He seemed and I know this is the subject of a lot of debate. I don’t drink, so I’m hard for me to tell what the difference is from still being drunk or being in that phase where you’re hung over. To me, he looked hung over.
    Q. And so he looked hung over, sitting on a couch in a robe. He has pants on.
    A. Yes.
    Q. And you then wrote is this the point strike that. You said that you expected a time would come when you would go in and try to help sober Mr. Jackson up. What did you do when you were in the room?
    A. I talked to him.
    Q. And what did you talk to him about?
    A. I said, “Michael, are you okay?” and that’s when he said to me that he was really concerned that people, there was not going to be anyone there, and that people didn’t care anymore, maybe you know, maybe this would be a bust, or something to that effect. At which time I explained to him that, “Michael, you’re quite wrong. You’ve got over 3,000 adoring fans who have been there for hours waiting for you, probably camped out overnight the night before. And you have every major press organization in the world. Trust me, Michael, they want to see you.”
    Q. Did this surprise you that he was concerned about the press conference, and people wouldn’t be there, they were not interested?
    A. No, because Dr. Tohme had asked me if maybe we should hire a crowd, a rent-a-crowd to be at the airport when he arrived to make him feel good. And, no, we didn’t do that. We didn’t have to. We just had to leak that he was coming, and the fans find out.
    Q. Okay. And did Mr. Jackson start getting ready?
    A. Yeah. He got up and went into the bathroom with Dr. Tohme and the and Alberto may have been helping at this time. I can’t remember. And the woman who was serving as the hair, makeup and also doubling as a nanny, because the kids were in the other room
    Watching tv.
    Q. And it says: “Tohme and I have dressed him. And” I’m sorry. You then responded
    Ultimately to Mr. Leiweke. At this point you say I’ll get to the scream part in a second. The second part, you say: “Tohme and I have dressed him, and they are finishing his hair, and then we are rushing him to the 02.” what did you mean by that?
    A. Meaning, Michael came out of the bedroom, the master bedroom, with Dr. Tohme, and he was standing there. And he had black slacks on and boots and a white v-neck t-shirt. And then they were holding I don’t know if it was Alberto holding the two shirts, but someone was holding two different shirts. One was black, and I think one was blue or red. And there were three shirts. There was a red one. They were all the same. They had this, like, sergeant’s chevrons on the sleeve, and this ornate kind of stitching and detail. And they asked me, which one should he wear? And Paul told me there was going to be a red backdrop, so I said he should wear either the blue or the black one, and I think it was the black one.
    Q. Is that what you meant when you said we dressed him?
    A. Yes.
    Q. Were you, like, literally physically dressing Mr. Jackson?
    A. No.
    Q. Okay. Are you aware of anybody physically dressing Mr. Jackson other than Mr. Jackson?
    A. No.
    Q. We’ll skip the next one, because that one you were asked about, and there’s one you weren’t. “he’s an emotionally paralyzed mess riddled with self-loathing and doubt now that it is show time.” what did you mean by that?
    A. That was the my reflection and observation of my conversation with him when I first walked into the room. And he was so insecure about whether people even cared, and this thing was going to be successful.
    Q. And you also say, “he is scared to death”?
    A. Yes.
    Q. When you say, “right now I just want to get through this press conference,” what did you mean?
    A. What do I mean? I think any human being in that situation wanted I just wanted to get him to the press conference, hope it went well and be done with this and forget this day ever happened.
    Q. “I screamed at him so loud the walls were shaking.”
    A. Yes.
    Q. Now explain to us what you did.
    A. Okay. I admitted to being a bit of a drama queen. I was so nervous about the situation. I created so much tension in that room at the time because I was tense, and you could cut the tension with a knife because time was ticking away, all these things were happening at the same time. And Michael wouldn’t leave unless he left with his armband, the sequined armband on his shirt. And they had to ask the hotel engineer to go and figure out how to put this armband on, because they had no way of securing it. And that, to me at that point that was more than I could take
    Q. Okay.
    A. Okay, because we were really this thing was ready to fall apart, we would have never gotten there on time, and we were spending 10, 15 minutes to try to figure out how to put on an armband. So what I did, I actually I raised my voice and pretty much said, “okay, guys. Enough.”And I then wrote it like this where it really isn’t a full reflection of what happened.
    Q. And at that moment did it seem like the scariest thing you’d ever seen?
    A. Yes. It was pretty close.
    Q. In retrospect, was it the scariest thing you’d ever seen?
    A. No. There are much scarier things.
    Q. Did you get him downstairs in the vehicle to get to the 02?
    A. Yeah. I then went into jester mode to kind of lighten up the whole thing. And we got downstairs and had a very funny we got into this big oversized van and had a very funny ride to the 02.
    Q. So the mood changed?
    A. Yes. I had to change it.
    Q. And did he because you kind of created it?
    A. Yes.
    Q. Okay. And on the way there, did he remain nervous?
    A. No. No. He was actually quite funny in the van.
    Q. And what happened when you arrived at the 02?
    A. Uhm, he got out of the van we all got out of the van. He got out into a golf cart with Dr. Tohme and Alberto, I believe, and whoever the driver was from the 02. I Rob Hallett was there. I walked behind him, and they drove him down this hallway to go in to get ready to go onto the stage for the press conference.
    Q. Have I put that into all the context of what happened that day, where you were coming from and everything else? Have I missed something?
    A. Well, the van ride.
    Q. Okay.
    A. Okay.
    Q. What happened in the van ride?
    A. Well, we had helicopters following us, which is, luckily, the only reason the press, the people didn’t leave and fans didn’t leave, because you could see on the news, they were covering it live, that we were going to the press conference. So that was a godsend that that was happening. And in the van, Michael kept saying to me, you lost literally 10 times because he knew what he
    Did wasn’t the coolest thing in the world to everybody. And Mark Lester was in the van with us. He had arrived at the hotel as we were getting ready to leave. Mark Lester was Oliver twist.
    Q. The Oliver Twist guy you mentioned.
    A. He was his friend. He kept saying to me, you know, “you look great. You’ve lost a lot of weight.” and literally, I was the heaviest I had ever been in my life. And finally literally 10 times. After the 10th time, I said to Michael, I said, “Michael, okay, you would have lost weight if you were pacing in front of your hotel room waiting for you to leave,” you know. And it got a laugh, and the whole thing. It was good. I mean, his mood, everything was much better in the van. We had some great conversations. I mean, he and Dave had a conversation. I was talking to Tohme. I got to know Mark Lester, because we had about an hour and 10 minutes to get there.
    Q. So let me make sure I understand. The press waiting, the fans waiting, the helicopters are following you, and it’s about an hour to get there. Did this help build up the promotion for the announcement at the 02?
    A. In an odd way, it created more anticipation and made it a bigger event, as people doubted whether it was even going to happen, yeah.
    Q. How did you think the press conference went?
    A. Well, considering Michael was supposed to write his remarks the night before and hadn’t, so I had to quickly write them as I was running behind the golf cart, I was writing, coming up with things for him to say, and we you know, I basically wrote like five lines out, “This Is It,” this is the last time, you know, whatever he said was stuff I wrote and put in the teleprompter, and he improvised a little. But what I noticed is, when he got off the golf cart, and there was a curtain and then some steps, and then there was the lobby to the 02, and there were 3,000 kids, and fans, not just kids and all the press and the cameras, I watched him. And you know, and I’ve said this before, the chart of homo sapiens, when they’re hunched over, then bigger. That’s how he looked. He started a little hunched over, got up, got up, and when he went through that curtain, there was Michael Jackson.
    Q. And there’s a clip of that commentary by you in the film, was there not?
    A. Yeah. I think in the special.
    Mr. Putnam: I would like to show that, if I can, your honor, so the jury can actually see that.

    To all the people who were/are against this lawsuit do you still think this lawsuit should never have taken place? I for one am glad this trial is taking place AEG Randy Philips and company are being exposed, without this trial we would not have known how horribly they treated Michael.

    And for the people who say “This trial should not have happened because ultimately it was Michael to blame for his death”

    I would like to ask them was it Michael’s fault that he got thrown in to a cold shower like a piece of raw meat?

    Was it Michael’s fault Randy Philips slapped him?

    Was it Michael’s fault that people like Karen Faye expressed serious concern about Michael’s health but AEG Randy Philips and Company chose to ignore it and just saw Dollar $igns?

    You sound like you are watching a movie or reality show. “We deserve to know it”. You deserve to know what pain the mother was feeling when she heard about it? And how it stabbed her in her heart? You want to know whether she simply froze at hearing it or whether she burst out crying? And you want to know how long and how loud her tears were?

    And what are you going to do after you learn of her reaction? Assess it? Dissect it and judge whether it was genuine or what? And are you sure you have the right to do it?

    What was your reaction when you heard it? I remember mine – my heart sank and I just sat there unable to do anything. Turned into ashes within seconds. Didn’t cry or utter a word and felt as if under a tombstone. It was only hours later that I managed to move that tombstone a bit and write just one sentence in the blog. It took a lot more time to make myself write a post about it.

    Was my reaction correct in your opinion? If it wasn’t can you advise me please what would be a correct reaction to this news?

    Then it explains it. It is the usual AEG’s cunning which is absolutely devilish. They approached them a year ago knowing that Katherine’s case would eventually go to court and by the time it starts these four guys will be bound hand and foot by their obligations. This is what AEG is all about – planning each of their steps well ahead so when the event arrives you suddently find yourself helpless and in a trap.

    This is why the best way to deal with AEG is not to deal with them at all because you simply cannot outsmart them.

    In the Jacksons’ place I would say it pointblank – we are bound hand and foot (probably by a confidentiality clause in their contract) and cannot comment. Or say that they agreed to a tour well in advance when no one yet knew of the terrible things that would be disclosed at the trial. Or that they made a mistake and that AEG simply outsmarted them.

    It is better to admit you are a fool than look like a betrayer of your brother.

    But they just cannot keep just silent.

    I’ve looked up the confidentiality clause in Michael’s contract and see that saying all these things should not be considered a breach of their contract with AEG. After all they are not prisoners of AEG and can have their say.

    Michael’s confidentiality clause says only this:

    16.2 Confidentiality. All of the material supplied to each of the parties by the other which is of confidential nature shall be the sole and exclusive property of the party producing such material, and each of the parties shall keep the material confidential and refrain from disclosing such material to any third party (except for the parties’ respective representatives who agree to honor such confidentiality) without the express written consent of the other party. The material terms of this Agreement shall be confidential except to the extent necessary to enforce the terms hereof or as required to comply with the law (such as for example, pursuant to a court order, or where a party must disclose such information to a tax advisor or accountant for purposes of preparing tax returns or financial statements).

    Murray’s confidentiality clause is much stricter as they did not want Murray to disclose to anyone what he was doing to Michael. I suppose that usually patient/doctor relations are ruled by other documents and obligations to which all doctors subscribe irrespective of who they have contracts with. It is simply a rule not to disclose medical information about their patients to anyone, so Murray’s confidentiality clause in his contract with AEG does look excessive. I doubt that Jacksons have anything like this:

    10. CONFIDENTIAL INFORMATION. During the term of this Agreement, GCA, Dr. Murray and his affiliates (including but not limited to his family members and the Assistant), employees, and agents, Dr. Murray’s representatives may gain access or be exposed to certain confidential and proprietary Information relating to his business of Producer and/or Artist. GCA and Dr. Murray agrees, for himself and representatives, that all such confidential and proprietary Information shall remain and be kept in strictest confidence and shall not be disclosed to or used by any person or entity without the prior written consent of Producer, which consent may be withheld by Producer in its sole and absolute discretion. The obligation to maintain confidentiality provided herein shall survive any termination or expiration of the Term of his Agreement and may be enforced by injunctive relief or other equitable or legal remedies without the necessity of posting a bond or proving inadequacy of legal remedies and without proving that Producer, Artist or any of Artist’s or Producer’s respective affiliates or any of their respective affiliates, partners, Producer’s, employees, agents, or representatives would suffer irreparable hard as a result of a violation of such confidentiality obligation.

    AEG can still claim that the brothers are creating bad publicity for the show, but Jacksons are not supposed to say anything bad about AEG. They can actually say that AEG is on its best behavior with them now, and this is why they went for it at all.

    I really think that AEG is now behaving to them as nice and fluffy white little kittens. Pure charm under which these four guys fell.

    Alley cats have more morals than AEG Live, Michaels brothers are fools for working with AEG. They are not helping Katherine’s case any. It just seem ludicrous that they want to work for these devils while all this is going on. It does not say much about brotherly love does it, or loyalty to Michael.

    Anything is possible, but then in their place I would state things the way they are. “We have obligations towards AEG and need to fulfill them no matter what”. Honesty is the best policy.

    And if they cooperated with AEG after Michael’s death it isn’t anything incriminating either – none of us could imagine then what was standing behind that footage and that film and all were enthusiastic to see it. I myself saw it several times and liked it.

    But collaborating with AEG now , during the trial is simply unheard of. It is undermining everything Katherine Jackson is doing. She wants justice and wants to learn the truth about her son’s death, but by their cooperation with AEG Michael’s brothers are sending a message to the world that they cannot care less about all this justice. Whether AEG drove or didn’t drive their brother to death does not matter – they will do business with AEG all the same.

    It is a very big mistake on their part to think that AEG will miss their chance of turning it into huge PR campaign. The media is only waiting for a chance to tear Jacksons apart. If they had refused AEG’s offer explaining that their dignity and pride do not allow them to colloborate with AEG the media would surely keep silent about it, but if they do work with AEG the media will go into a hue and cry and will drown the family in the mud.

    They don’t understand what they are doing. Anyone can cooperate with AEG, except them. Some people simply cannot work for AEG and that’s it – of course if they care for Michael. I for example, cannot work for them either – even if they offer me millions. Not on your life. The same with Jacksons.

    Helena that is truely a strong opinion, but a sincere one . You at least are consistent in your opinion of the trial and use no agenda, fallacies or irrelevant arguments to back up your opinion.

    Maybe they can make a statement if they have the guts , to call out AEG in their own venue, like Prince did in his O2 concert

    The Jacksons don’t understand that if they take the AEG bait and perform at some festival organized by them the AEG PR machine will make the most of their participation in the event. Under normal circumstances no one will really know who is the organizer and it does not really matter – everyone looks at the artists, but not in this case.

    In this case the organizer is the central news and the fact that the Jacksons “work with them” sounds like the Jacksons’ own disproval of their claims against AEG. If they are so resentful of what AEG did to their brother why are they cooperating with them then?

    The festival has not yet started but the AEG PR machine is already working. Look at the article below from the LA Times – of all artists they select the Jacksons only. Look at the catchy headline – it is meant to tell the story which does not even exist at the moment, and this is only the start of it. With each day it will turn only for the worse.

    And if the tickets do not sell, it will be simply a PR gift to AEG – “they tried so hard to help the desperate brothers but alas no one wants them”. It is a TRAP set for the Jacksons and they have got caught in it.

    While Michael Jackson’s mother and three children are suing AEG Live for what they say is the company’s role in the pop singer’s death, four of his brothers will perform this month at a festival the entertainment giant is producing and promoting.

    Jermaine, Tito, Jackie and Marlon Jackson will close out the three-day BET Experience on June 30 on a bill with R. Kelly and New Edition. The festival is being produced by AEG and will be staged at LA Live in downtown Los Angeles.

    “What are their options about performing?” said Kevin Boyle, the attorney for Katherine Jackson and her grandchildren. “Why would they not perform?”

    The Jackson’s upcoming performance came up this week during testimony in the wrongful death suit filed by Jackson’s mother and children. The case could be worth billions if jurors determine that AEG played a role in the singer’s death.

    Michael’s wrongful death trial during the testimony of Randy Phillips, AEG Live’s chief executive, who spent his fifth day on the stand. Since late morning, though, his attorney was asking the questions, not the Jacksons’ lawyer.

    Although Michael Jackson came to fame as lead singer in a group with his four brothers, he had a strained relationship with his family. Randall Sullivan, author of “Untouchable: The Strange Life and Tragic Death of Michael Jackson,” said many family members looked at the singer as their meal ticket.

    “The persistence with which they exploited him was breathtaking and was relentless, and it was right until the moment of death and after,” Sullivan said in an interview. “He was the one really talented person, and they all lived off him and took advantage of that talent to best of their abilities forever.”

    Attendance at the Jacksons’ tour last year was disappointing, and they failed to sell out the Greek Theatre.

    Several Jackson siblings sent a letter to the executors of Michael Jackson’s estate last year, accusing them of fraud, forgery and abuse of their mother.

    The letter claimed the executors were manipulating Katherine Jackson and affecting her health. The letter also claimed Michael Jackson’s will, which cut out his siblings and left his estate to his children, his mother and charity, was a fraud.

    In court Tuesday, Randy Phillips, AEG Live’s chief executive, also testified that he met with Jackson in Las Vegas in 2007 at the singer’s behest, to discuss touring. Jackson also said he wanted to do a TV mini series on King Tut and star in movies. AEG owns a film production arm.

    During one meeting, Jackson showed AEG executives a 20-minute special-effects laden film he had financed, called “Ghost.”

    Phillips said Jackson was “animated, clear.” AEG made a proposal to Jackson, which included starting a tour in London. AEG later received a call from a Jackson representative saying he was not ready to go back on stage.

    The next year, Jackson began negotiating with AEG again, paving the way for the “This Is It” concerts in London. Jackson died after being administer a fatal dose of the anesthetic propofol as he was rehearsing for the comeback shows.

    Philips and another AEG Live executive are defendants in the lawsuit. The Jacksons say AEG negligently hired and supervised Conrad Murray, the doctor who administered the propofol. AEG says Jackson hired Murray and that any money the company was planning to pay him was part of an advance to the singer.

    The Jackson family is their own worst enemy.I wouldnt be surprised if Katherine shows up to watch them perform and drags MJ kids along for the ride.
    Janet has also been in talks with them since MJ has died and this suit has been in the making.
    MJ had told the Rabbi, that his family wasnt smart when it came to these things, they run to be on television or get a camera in their face, I would assume this springs from Joe, not just telling MJ , he was nothing to him, if he wasnt performing, but the rest of them as well.
    To subject MJ children to this suit and have these relatives , who no doubt , will be given a cut , if Katherine should prevail , and have them look like the village idiots, is just par for the course…
    This is why AEG has advertised this all to the media and the jury as well, because if his own family will work with them , it undercuts the case ..
    AEG also made a point in an article that they had to cancel a show last year, unfortunately, due to POOR TICKET SALES..
    Makes them sound desperate and broke…and AEG contends this is a money grab..
    In my own opinion, they had been off stage for 20 years when MJ was alive, they could have waited a while longer if they were serious about this case.
    If they needed the money , Janet isnt broke..I would think they could prioritize.

    There is no need to campaign for boycotting AEG but people should show their attitude to what AEG did at least in some way. The Jacksons should have stayed away from them like the plague.

    AEG is simply buying them and using them for their own needs. Buying them with most probably the best terms and impeccable behavior. And a lot of flattery and promise that they will ‘make up’ to them for what they ‘accidentally’ did to their brother. And all the other soothing talk – we are good, we are nice, we are cute and fluffy white little kittens.

    But only complete idiots can fall into this trap. They were simply hired by AEG to wash off the AEG image of the blood that was spilled all over them when they brought Michael to his death. Now AEG’s message to others is – if even the Jacksons are working with us then all the others should do too. See how nice we are?

    NO, AEG is not nice. Any talk with AEG can start only when Randy Phillips is fired.

    And these idiots are touring now as live propagators of their love for AEG? Okay, not touring but at least performing on one of AEG’s venues?

    It is simply another slap in the face of Michael Jackson. Especially during the trial. They could at least wait until it was over.

    I am a woman of strong opinion of course, but all this collaboration with the company which ground down their brother and in so terrible a way is immoral, idiotic and can breed only contempt. This AEG case is all about ethics in behavior and the Jacksons are the first to break all ethical rules.

    There are no impossible situations in life (except death of course). In all other cases there is always a choice to make. And the choice the brothers have made is utterly unethical. It is better to be a beggar than collaborate with a murderer. This flirting with Evil will surely backfire.

    I hear that AEG has a competitor – Live Nation. In their place I would have agreed to work with Live Nation at three times lower a fee than with AEG, no matter how much they offered them. That would be “foolish” by the standards of our world, but at least ethical.

    Nina ,ofcourse there is a Jackson Dynasty, but this refers to the days they played together.
    Already then Michael was the star,but the band was great. I was talking about a non-program by the ,or some of, the brothers made a year or 2 ago. They were just shoving themselves here and there in the world shopping.No songs or art. Maybe it was not shown much.

    Its hard to keep up with everything ,let alone write about it.
    Sometimes I feel like entering a Kafkaian world where nothing makes sense, yet people make it like nothing special. I think because Michael was larger than life, people de humanize him and accept whatever happens to him as coming with the territory.

    It is a legitimate question to ask whether the Jacksons should perform in an event or venue where AEG is involved.
    In a perfect world there would be no AEG who OWNs half of the market of venues, live entertainment and sports events, Michael would not have even considered working with them and be subjected to their shameless bullying and worse . Neither would Prince(Nelson) be challenged to call them out in their own venue, nor would BET ( Black Entertainment Television!) ) engage with them, considering their involvement in a black artists death. And the Jacksons would stay far from anything AEG.
    However , this is not a perfect world. Half of all the live concerts are AEG related so any performing artist ,somewhere along the line will be involved with them.
    Its pretty useless to start a boycott if no other artist will join in this time, when artists for lack of record sales depend heavily on touring and merchandise, which are all monopolized.
    Besides I do not put it pass a section of MJ fans to start a pro AEG campaign if anyone dare boycott AEG.

    @ Kaarin, I dont know if you were around J5 /Jacksons era or what you know about it, but yes the Jacksons were a family dynasty. Like the BeeGees, far more succesful than the Osmonds and definitely far ahead of the Partridge family .Everyone in the world knows a handful of J5 songs.
    I saw them in the 70s, 3 years ago and last year . I have seen enough live artists and most of the greats of my time, to separate the reals from the wanna be’s and the latter they are not.
    You don’t have to like them, or their music, but there is no need to downplay their achievements.

    It’s no wonder entertainers are afraid to speak out in behalf of Michael. The implied threat that they will then be finished in a heavily controlled industry will restrain anyone, including Kenny Ortega, etc. etc., from straying off-script. The best way to shut people up is to threaten their livelihoods. The paying public could easily fix that by boycotting AEG-sponsored entertainment. It would certainly lead to a shake-up of the upper echelon of that company, particularly if the boycotting public would be vocal about it. Anschutz should fire Randy Phillips for his unprofessional conduct. Should have a long time ago.

    This is not good news.There is no Jackson Dynasty, there was only Michael,who was exeptional.Wonder if AEG gave them such great terms that they could not say no,as they should.Conflict within the family will play into AEG´s hands.There is no lack of money,Janet married a multi billionaire from Qatar.Can she not help the poor brothers.They were good as a band when Michael was still a child,but the star nevertheless.She also converted and thre has been pictures of her wearing that all black whatsoever.

    Well, what can you do when they are the only ones who own all these big venues and you need these places to perform? The alternative is to stop working at all or go only to small venues. I think that’s a problem now for a lot of artists who perhaps would like to boycott AEG, but need their venues for their performances. It’s a difficult decision, isn’t it?

    Helena: It looks like it was not Karen Faye who was with Michael in London on March 5th, 2009 (she started her work later). It was said that it was a nanny who also did Michael’s makeup and hair.

    Randy Phillips testimony consisted mostly of NO clear answers. He did not remember,not see ,and most times first repeated the question Panish had asked. Instead of answering he was tangential attempting to get into ,or rather get out of the essence of question asked.I wondered do these people not keep calenders of their daily tasks. I think that is rather common with anybody in a responsible position. Most have secretaries doing it. This squirming on RP´s part made the sessions long and gave little evidence exept that of evasivness on RP´part.This style forced on Panish by this witness seems to have annoyed the judge too. Judge stated that if RP is evasive the jury will take note of it. I hope they do.
    As to the treatment of Michael, it was horrendeous.Everything was done to humiliate him all along the way.Not surprising it was said he seemed to have lost his former selfconfidence.Just another method of reducing his capacity to and enthusiasm to perform.
    And points to the fact that AEG did not really care either way, weather he did manage the program or not.

    I’ve been thinking about it too. Randy Phillips’s slap, most probably in Michael’s face too, helped me understand a few painful things, some of which are about my own people – because despite all differences we have a similar past.

    A slap is not an argument one would use if the relations are equal – it is the ‘argument’ in a master-servant, master-slave relations the traces of which are still felt even when the ugly system is officially gone. In the US this system historically had a racial coloring as it were blacks who were put into a position of servitude, but in my country the same was between whites. On both of us this vicious, inhuman and corrupt practice of considering some people better and first rate and some people worse and second rate had a terrible effect – a terrible one. It corrupts both sides and corrupts deeply, each side in its own way.

    The ugly system is gone but the master-servant mentality is still there, lingering somewhere in people’s minds and veins, and occasionally it breaks out into the open through gestures like that slap. Your media is silencing this fact most probably because it is too obviously a racial factor and they are probably even afraid to talk about it openly not to face a huge wave of fury over it. Hence all these attempts to silence it and play it down. They are probably trying to keep social peace this way.

    But the discussion is needed, because if there is none this ulcer will be only deepening. In my place they (even the church) prefer to ‘forget’ about the several centuries of the shameful past and this is why the disease does not go away.

    I’ve already said what I think of this expression and will just repeat.

    As far as I understand Karen Faye was also present during that scene (and will hopefully tell us more when she testifies again, I hear she will). Michael’s nose was very much in place but we don’t know whether it had patches, scars, etc. to which she was to apply some make-up.

    “Getting his nose on properly” is a statement which betrays Randy Phillips’ general contempt for Michael. Its meaning is something like “I scraped him off the floor” which he said to Karen Faye and which should not be understood in the literal meaning of the word either. All these expressions go hand in hand with the AEG overall approach to Michael as a “freak”.

    “No one is saying anything about this, but because of damage from Lupus, MJ might have actually needed a prosthesis to cover lesions across the bridge of his nose. Dr. Steve Hoefflin also once said he had to use skin from behind MJ’s ear to place across MJ’s nose. Do you know anything about this?”

    What I know is that firstly, there was no prosthesis as the autopsy did not show it and recently the doctor who conducted it sent a message to the fan who asked, emphatically stressing that all talk about a prosthesis is not true.

    One of the paramedics mentioned that Michael had a piece of band over his nose. I also read in Karen’s comments that Michael was wearing the band to prevent the skin from stretching.

    I also know that Dr. Richard Strick who was working for the government in 1993 studied Michael’s medical records and said that all follow-up operations on Michael’s nose were a forced measure – they had to be done to deal with the effect lupus had on (the bridge of?) his nose.

    When Hoefflin was making the initial plastic surgery he did not know about Michael’s Lupus as it was diagnozed by Klein later. Plastic surgery is absolutely not recommended for lupus patients as lupus may lead to the necrosis of the skin and in all cases it leaves scars. Scarring is inevitable in case of Discoid lupus.

    So Michael could easily develop scars on his nose which Hoefllin and Klein had to take care of.

    Phillips’s expression that they “need to get his nose on properly” is simply a sign of utter contempt he had for a man who had to have a thick layer of make-up to disguise all that scarring.

    We should stop taking all these words literally and should see what they really stand for – ridicule, contempt and probably even hate which Randy Phillips was expressing that way.

    Its real meaning is “This freak cannot even show his face to the public without his nose being done”.

    Examples of lupus scarring:

    Seal also has discoid lupus scars. Look at them and you can more or less imagine what problems Michael could have (probably even before the This Is It tour). Klein was not treating him just for nothing.

    On Thursday,March 5Th 2009 Michael had all the reasons to feel intense anger at Randy Phillips and Thome Thome.How cruel to push Thome´s presence on him as he had just found out about the auction this this leach had started on the sly.His “self-loading mess” was his anger,resignation and helplessness when faced with AEG´s machinations and betrayal.
    The long trip with 3 young children +jetlag added to his tiredness and distress. Instead of beating up these 2 men he became a victim of physical abuse.Cold shower and slapping smells like torture. Surprisingly he was able to make the announcement. It´s likely that this horrible expierience worsened his insomnia and he started looking for some resolution.
    MJ is a citizen of the world,close to S.A. expresident Mandela,introduced to royalty and invited to visit Charlie Chaplin´s widow at her home in Switzerland.The AEG bosses are but vermin compared to him.

Personally I’d like to hear more about the substantive issues like how Phillips and AEG abused MJ with such impunity. Why the massive and apparently co ordinated attempt to mislead the world? MJ’s truth gets as much, or more readership as the lies. So we know that it’s not about money. What else is there? I still believe its racial prejudice. Yes even with a black president in the US. Don’t forget the racial hatred directed at him. The US has a vile history of racial hatred. I can almost guarantee that all the rabid MJ haters are white. This hatred is almost as strong as ever but its gone covert. However its such a strong force that it pops up with little or no provocation. I believe MJ in their minds went too far in challenging the status quo. How dare a black man who did not follow their agenda, command such international influence and acclaim? He needs to be beaten into the ground until he, and what he stands for are totally destroyed. I understand that this idea is unpalatable to some of us but we must at some time face this possibility. Of course I know that everyone is not like that, but all it needs is a small group of haters who are able to control what others think. Based on what is happening we are likely to see the same result as the molestation trial. MJ will be exonerated in court. but the world will see it as an underserved victory. We know the truth, but its not enough, and so the lies will win. I believe we need some high profile allies who can call out the media for their lies. In my country the media could not do this without penalty. Once we get the media to report the truth, then we need not worry about MJ’s legacy.

    You know what, guys? Considering that search browsers are not providing us with correct information if we search for ‘slap’ and ‘Michael Jackson’ I’ve changed the title of this post to make the search easier.

    This will probably make the previous links to this post non-workable but this is the price to be paid for the title changes. Generally I try not to change them too much even when I notice some mistakes there.

    P.S.

    The search for “Randy Phillips slapped Michael Jackson” does produce some result now, but this result is rather interesting. All of them are quoting what Phillips actually did not say.

    He said “I just slapped him” and look at what they are quoting? It is already in the headline that they are explaining why poor Phillips had to do it (the first entry is different because it is a MJ site):

Read the f’n article again maggot Randy Phillips, testifying in the Jackson wrongful death trial, recounted that it was “a miracle” that a “drunk and despondent” Jackson finally appeared at the London event.
