Jackson family is seeking $290 million in personal damages from AEG
For the first time, the family’s attorneys put a dollar figure on what they want for the singer’s death. That doesn’t include economic damages of as much as $1.6 billion.

An attorney for Michael Jackson’s family told jurors Tuesday that concert promoter AEG Live hired the doctor who administered the fatal dose of an anesthetic and that the company now should pay for the singer’s death.
Brian Panish told jurors that AEG should have to pay non-economic or personal damages of $85 million to each of Jackson’s three children and $35 million to his mother.
The AEG lawyers are smirking and laughing.
This marked the first time in the nearly five-month-long trial that the Jacksons have placed a dollar figure on damages they are seeking from the entertainment company.
Those figures could be dwarfed by the economic damages, however. Panish told jurors they would have to sort that out, but he showed them a slide that reminded the panel that an expert witness testified the singer would have earned $1.2 billion to $1.6 billion if he had lived, from new music, tours, endorsements and a Las Vegas show.
“We’re not looking for sympathy,” Panish said. “We’re looking for justice, full and complete.”
Panish, speaking in a much more low-keyed manner than when he took testimony, quoted Abraham Lincoln and the Book of Exodus during his daylong closing argument.
He also went straight at the question of Jackson’s culpability in his death. “It’s about shared responsibility,” he said. “Michael probably has some fault…. I’m not going to deny that Michael used prescription drugs and that people told him it’s risky to use propofol.”
But he said that if Dr. Conrad Murray, who gave Jackson the anesthetic for 60 days to fight his insomnia, had not been hired by AEG, Jackson would still be alive.
“No Murray, no AEG, no propofol, Michael’s still here,” he said.
Who are the guys the camera constantly focus on?
The Jacksons have sued AEG for Jackson’s death, saying the entertainment firm negligently hired and supervised Murray. AEG maintains that the doctor worked for Jackson and any money the firm was supposed to pay the doctor was an advance to the singer.
AEG attorneys are set to make closing arguments Wednesday, and the case could be in the jury’s hands by the end of the week.
Throughout the day, Panish showed jurors the emails that are perhaps the Jacksons’ strongest evidence that AEG hired Murray.
One from AEG executive Paul Gongaware talked about an upcoming meeting with Murray. “We want to remind him that it is AEG, not MJ who is paying his salary,” Gongaware wrote. “We want him to understand what is expected of him.”
Panish used the faulty memories of Gongaware, AEG Live Chief Executive Randy Phillips and Tim Leiweke, then chief executive of parent company Anschutz Entertainment Group, to his advantage.
Panish put up a rapid fire video showing the three men testifying during their depositions using a variation of “I don’t know” or “I can’t remember” as many as 30 times each.
“They made a legal strategy not to remember anything when they testified under oath,” Panish told jurors. “They’re not credible or worthy of belief.”
Panish also showed a television interview in which Phillips talked about Murray.
“The guy’s willing to leave his practice for a very large sum of money, so we hired him,” Phillips said.
“It’s real simple,” Panish said. “He’s the CEO of the company, as high as it gets. He admitted it.”

A lawyer for Michael Jackson’s family asked a jury on Tuesday to act as the conscience of the community and award damages for the loss of the pop star’s life.
Attorney Brian Panish delivered his closing argument in a packed courtroom, explaining why jurors should believe that concert promoter AEG Live LLC was negligent for hiring the doctor whose actions led to Jackson’s death.
Panish played videotapes of testimony from the 21-week civil trial and said it’s clear that AEG hired Dr. Conrad Murray, even though the contract with him may have been more oral than written.
AEG Live is accused of failing to investigate Murray’s background because the company was anxious to launch lucrative concerts.
Murray was convicted in 2011 of giving Jackson an overdose of the anesthetic propofol as he tried to sleep during preparations for his “This Is It” concerts in London.
Some witnesses said Jackson was ailing at the time.The promoter claims it was Jackson who insisted that Murray treat him because the former cardiologist was giving him propofol as a sleep aid.
AEG Live drafted a contract for Murray’s services, according to testimony, but it was never signed by anyone except Murray before Jackson died.
The lawyers who brought the suit on behalf of Katherine Jackson and the superstar’s children were allotted four hours on Tuesday for their initial presentation.
Attorneys for AEG will speak on Wednesday, also for four hours.
The plaintiffs, who have the burden of proof, get to speak a second time. In that grand finale, probably on Thursday, they are likely to tell jurors how much money the Jacksons are seeking for the loss of the superstar.
They are expected to ask for more than $1 billion, citing testimony of experts who said Jackson had a long lucrative career ahead of him when he died at the age of 50.
The judge moved the proceedings from her tiny courtroom to a larger courtroom to accommodate media, spectators, lawyers and Jackson fans who line up daily for a lottery to win seats in the courtroom.
The fans huddle and discuss the case in the hallway and wait to see Katherine Jackson enter the courtroom. Some wear T-shirts emblazoned with her picture and messages of support.
On Monday, Superior Court Judge Yvette Palazuelos gave the jury legal instructions. Everyone has biases, she said, but they must not be swayed by prejudice, sympathy or public opinion while deliberating. They also were told how to evaluate evidence and witnesses.
Mr.Panish said he apppreciated the jurors’ attention and thanked them
If the jury finds that damages should be assessed, the judge said they must not consider such issues as the grief endured by the Jackson family or the wealth of both sides in the bitterly fought case.
The instructions lasted about 30 minutes, a relatively short time because there is really just one central issue in the case: Who hired Murray? Was it AEG Live or Michael Jackson?
A unanimous verdict is not required. Only nine of the 12 jurors must agree.

mjsmelly I agree.There is something that has puzzled me.How come Murray ended up being broke. There were no malpractice stains on his record. And I totally disagree with Randy Phillips view that he was a successful doctor, And the more he spent time with him the higher his regard for him! HA!.He was a a very ignorant doctor and had no ethics.Maybe there were not that many patients who liked him afterall.You can not judge a doctors skill by his wealth,but a doctor should be able to earn enough for a reasonably comfortable living.

Guys, now that I am reading part 1 of Mr.Panish’s closing arguments I realize that his version of the events has not even scratched the surface of what really happened to Michael – his story is just a very rough outline of the events, a very rough one.
Of course Mr. Panish is an attorney and not an investigator and these are different skills. And during the time he had during the trial there was no opportunity to pick up all the loose ends and bring them together, so a lot has been omitted.
But for us it means that after the verdict – whatever it is – we will have to read all the transcripts and start it all over again, trying to restore the events the way they really were.

Of course these 2 minutes are lies. Judging by Murray’s non-stop telephone calls in the morning of June 25th when he was attending to the insurance he stayed away from Michael for no less than 30-45 minutes.
As regards anesthesiologists Dr. Shaffer said that they never leave the side of their patient during the procedure. In fact during my operation I remember two anesthetists and one nurse anesthetist by my side – altogether three of them.
It is impossible even to imagine that a man like Michael Jackson received the worst possible medical care even in comparison with us, ordinary people. And this is the man who gave to hospitals all over the world a piece of medical equipment in every city he arrived to give a concert there! And wanted to build the best hospital for children with the money he was to get from his This is it tour!

And btw I suspect AEG has much to do with the negativity against Michael which seems to have incresed reading some newspapers and reports on HLN..Certainly they dont lack in devious methods.-It is terrible that Michael was left to die when so many, even AEG employees practically cried to the heavens over Michael poor health, and many did so somewhat hesitatingly fearing the future of their own careers.

Helena, when you have a patient “under” ie unconscious you stand or sit next to the patient and monitor pulse,breathing,bloodpressure and now and then check for pupillary reactions.This is done whether the patient is given propofol or an other anestetic.I have done an internship in anestesiology, though not chosen that for my specialty.If the patient is stable you can leave him/her for a minute or even 2, let another anesthetist keep an eye on him/her.Please check Lopsided man’s report on Murrays activities on the morning of 6/25.Much of this can now be done by electronic monitoring,but still you do not leave the patient.Besides I am 100% sure those 2 minutes Murray mentioned are lies.
-It constantly irritatates me when Randy Phillips praises Murray;,because he was licenced in several states and was a successful doctor.His economy was in shambles, well that can happen to good doctors too. You don´t measure success by money. But a million or more and his house to be forclosed?!

In connection with what I’ve just said in this comment https://vindicatemj.wordpress.com/2013/09/25/jacksons-vs-aeg-trial-marvin-putnams-closing-arguments/comment-page-1/#comment-51367 let me say that even MJ’s physiological functions suffered not so much due to propofol (which created only the illusion of REM sleep), but due to the lack of this REM sleep per se – with or without propofol.
Propofol simply masked the lack of sleep, but even if propofol had not been used the absence of sleep would have produced the same ruinous result.
The key to this problem is lying in the answer to a question why Michael could not sleep.
Dr.Metzger said that MJ could sleep with a conventional medicine for insomnia (Tyledol if I remember it right), and got adequate amount of sleep in January- February-March. However the problem started in April when MJ began asking about propofol for the first time and Murray began buying it.
Why in April?
Because in March something happened that brought about MJ’s terrible stress which in its turn deprived him of his sleep.
And you know the answer to it – it is 50 shows set by AEG without any regard for Michael’s wishes and for his very specific problem of insomnia.
Due to the schedule they set for him he could not keep to the dates in a natural way because he needed more than one day for recuperation. And this time he didn’t have and therefore was forced by AEG’s schedule to seek unconventional ways of solving his problem.
The most terrible thing here is that Gongaware perfectly knew of MJ’s insomnia from his past experience with him and MJ specifically asked AEG to change the schedule but they never did.
It is true that AEG may not have known that MJ would resolve to propofol, but it does not change anything as they knew perfectly well that with propofol or without he would not have been able to keep to the schedule anyway. There would have been cancellations, postponements of shows and it would have sent MJ into an endless chain of claims from AEG, and these claims of “losses” would have kept MJ as AEG’s hostage forever.
This is most probably the big idea of it from the very start of it – place him in impossible conditions, make him break the schedule, challenge him with their mounting “losses” due to re-scheduling the shows and this way never set Michael free for years to come.

Kaarin, I may have missed something but it seems to me that Mr. Panish did not talk about Murray required by his contract with AEG to perform services for the Producer and actually doing it during the time of MJ’s death.

Susanne, it is since the time when Tom Sneddon’s arguments as Prosecutor began to be repeated by many as the only truth of the matter despite the overwhelming evidence refuting them and despite the jury’s not guilty verdict.
If the media and general public still believe Sneddon’s lies brushing aside all the real evidence of MJ’s innocence presented at the 2005 trial, then it is quite possible for the same false mantras to take the upper hand now too.
Who needs the real evidence in a situation when all sorts of lies are repeatedly crammed into people’s heads?

I’m now home but a spike in my left arm started to move to the surface and before letting me go they “hammered” it back so I had quite a day yesterday. Fortunately there was a painkiller at hand. Each new experience like that helps me understand Michael much better.
But my major concern is not that, but the degree of maturity of the jury and whether they will be able to see through AEG’s lies and twisted logic. The jurors’ deliberations will be quite a test for their ability to see bitter truth behind the bright facade of lies painted for them by Marvin Putnam.
Yesterday he was hypnotizing the jury with the AEG usual mantra that “like all adults he was hundred per cent responsible for his own health”. The mantra has been repeated by AEG’s advocates all over the internet for months now.
But even taken as it is this formula is totally wrong because the responsibility for another person’s health also obviously lies with 1) doctors 2) bosses who should not be exploiting the person dependent on them bad enough to take him to his grave and 3) the degree of indifference of people around this person. If no one gives a helping hand to a dying man though they are able to help their guilt is also immense.
The fallacy of the AEG mantra is best seen if we add only a couple of words to it: “like all adults he was hundred per cent responsible for his own health” even when kept a hostage.
Mr.Panish’s job was to show that the conditions Michael was functioning in were indeed those of someone kept a hostage in terms of humiliation, harassment and exploitation of MJ. I’m afraid that up till now he has not explored this matter deep enough.

I couldn’t overcome myself to listen to Putnam all the time, but from the parts I saw he always was only reading from a script making endless boring statements without presenting evidence. As CT also said, he only used testimony of AEG witnesses as “overwhelming evidence”. And in addition, he wants the jury to disregard damning emails and statements of AEG executives. What does he expect of the jury – to be total fools? Since when is testimony of defendants regarded as evidence to prove a case?

Murray exchanged texts with the representative for the insurance company the morning that Michael died. This situation was absurd. Loopsided man made a good calculation of all murray phonecalls and texts that morning.

I believe that in the end-game AEG did not care whether Michael lived or died. And don´t tell me they did not know that Michaels physical as well as psychological condition got worse and worse.The extreme psychological symptoms that were described were the result of prolonged propofol administration which deprived him of life sustaining REM-sleep. And what made them think a cardiologist was THE doctor for Michael?.There was nothing wrong with Michael´s heart. I recall he had lost his certification for that too already. And late in the game AEG even put forward the idea of insurance for death..
They had arraged it so that their, AEG´s income was secured in any case. Or so they thought
Murray is a particularly bad doctor.I wil not now go into details why.No doubt he had a measure of psychopathic charm,must ahave to have so many out of wedlock children.I will never forget that Dr. Shafer did not charge for his testimony as he felt the whole reputation of medicine was at stake because of Murray.Somebody has said don´t listen to whats said .look were the feet, ie, the actions go.Murray became a very convinient tool for the purposes of AEG.Very obidient too,exchanging calls and texts with the insured when Michael was already dying.

I hope Putnam is equally offensive in his closing statement today ..The arrogance of these corporate lawyers, Im sure isnt lost on the jurors…Just makes people lean more to the the plaintiffs, and the respectful manner of Prince testimony , and the way he treated the defense lawyers also in the courtroom..all class

watched what i could yesterday, but missed thr part about the ending., discussing the financial stuff..
.I think the lawyers for the AEGshould have read or watched some of Tom Mesereau seminars regarding juries because I was disgusted watching Putnam and company smirking thoughout Pannish closing statement and Im sure Pannish was happy to see them behaving that way.
Mesereau said he was always amazed when a corporate personality picks a lawyer they are comfortable with , instead of one the jurors might be comfortable with and these people fit that description to a tee.
To show such a lack of respect for the deceased and his three children seems like suicide to me..They think smirking about the person who their clients thought could make them billions, it is just plain stupid, but a common mistake according to Mesereau, thinking they are playing to fellow high priced corporate lawyers..
The way to diminish MJ would be with a respectful demeanor and FACTS..
These people have nothing to give the jury..Instead they are showing the same contempt , that AEG treated the deceased with …very very stupid,..I think it is going to cost them big

TruthforMichael, everything done to Michael indeed amounts to a murder. Most of his life he lived in harassment and died of harassment too. As to the details of all of it we will hopefully find out everything one day.

Yes, Susanne, I am still in hospital and it is past 2am here but cannot take my eyes off the screen. It is such a surprise.
But it is also a surprise that Michael’s haters who think all this is a waste of time are also glued to the screen and are pouring tons of dirt on MJ on that HLN website. One would assume that they would not give a damn…

Wow, I’m impressed about your fast post, Helena. Are you still doing it from the hospital?
I’m really excited about this life stream, I didn’t expect it. And you know what? I really would like to have all these charts Panish has on the screen. Some of them are really great. There was a big one about Michael’s whole life and his diseases and accidents and how everything is connected. I hope we can see it again in a YT video or somewhere.
